HomeMy WebLinkAbout1982-06-15; City Council; Resolution 6905I I * 1 I f r 1 ! 1( 1: 1: 1; 11 1: le 1'; 1E 1: 2c 21 22 23 24 25 26 27 28 e RESOLUTION NO. 6905 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE, AND NECESSITY REQUIRE THE ISSUANCE OF A CERTIFICATE TO BILL'S CAB COMPANY, INC. TO OPERATE THREE TAXICABS IN THE CITY OF CARLSBAD AND ORDERING THE CITY CLERK TO ISSUE SAID CERTIFICATE SUBJECT TO CERTAIN CONDITIONS. WHEREAS, Bill's Cab Company, Inc., in accord with Chapter 5.20 of the Municipal Code has applied for a Certificate of Convenience and Necessity to operate taxicab service within the City of Carlsbad; and WHEREAS, pursuant to said chapter a public hearing was held on June 15, 1982, to determine whether or not the public interest, convenience, and necessity require the issuance of the certificate applied for and; WHEREAS, at said hearing all persons having interests in the matter were heard; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, as follows: 1. That the above recitations are true and correct. 2. That the public interest, convenience and necessity require the issuance of the certificate applied for. 3. That said certificate is hereby issued to Bill's Cab Company, Inc., to expire on April 21, 1984, subject to the following terms and conditions: ///I //I/ (a> The certificate permits service throughout the City of Carlsbad. (b) Three taxicab vehicles are authorized. (c) The schedule of fares to be charged shall be: $1.20 for the first 116 mile and $1.20 for each mile thereafter. $9.00 per hour waiting timeltraffic delay. No surcharge for out of area service and no charges for extra luggage or passengers. (d) The certificate and the operation of taxi service pursuant thereto shall be subject to all of the provisions of Chapter 5.20 of the Municipal Code. (e) The certificate is issued to commence on the date of adoption of this resolution and to expire on April 21, 1984. (f) Applicant's application form which is on file in the Office of the City Clerk, shall be made a part of this certificate, and is incorporated by reference herein. (g) The City shall have the right to inspect all vehicles at any time to insure they are maintained in safe operating condition. (h) Applicant may only use the vehicles listed on his application. (i> Applicant shall file certification of insurance in the amounts of $100,000/300,000 with the City Clerk prior to commencing service pursuant to this certificate. (j) No taxi stands are permitted. 4. That the City Clerk is hereby directed to issue a copy of this resolution as a certificate in accord with Chapter 5.20 of the Carlsbad Municipal code. 5.
