HomeMy WebLinkAbout1983-07-05; City Council; Resolution 7272l : I( 11 1; 1: 14 1: 16 17 1E 1: 2c 21 22 22 24 25 26 27 28 RESOLUTION NO. 7272 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AN AGREEMENT BETWEEN THE CITY OF CARLSBAD AND SAN DIEGO ASSOCIATION OF GOVERNMENTS FOR PROVIDING TRAFFIC ENGINEERING SERVICES. The City Council of the City of Carlsbad does hereby resolve as follows: 1. That certain agreement between the City of Carlsabd and San Diego Association of Governments for providing traffic engineering services, a copy of which is attached hereto and made a part hereof, is hereby approved. 2. The Mayor of the City of Carlsbad is hereby authorized and directed to execute said agreement for and on behalf of the City of Carlsbad. PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council of the City of Carlsbad, California, held the 5th day of July , 1983, by the following vote, to wit: AYES: NOES : None Council Mzmbers Casler, Lewis, Kulchin, Chick and Prescott ABSENT: Nolle d L- MARY H. &ASLER, Mayor ATTEST : /p (SEAL) e CITY OF CARLSBAD SAN DIEGO ASSOCUTION OF GOVERNMENTS AGREEMENT FOR CONSULTANT TRAFFIC ENGINEER SERVICES WHEREAS, the City of Carlsbad (City) requires the services of a part-time traffic engineer; and WHEREAS, the San Diego Association of Governments (SANDAG) has offered to supply such services, the parties hereunto agree as follows: SANDAG shall supply the services of traffic engineer acceptable to the City on the basis of 12 hours a week at a not-to-exceed cost of $24.60 per hour. Such traffic engineer shall be under the direction of the City Engineer and shall prepare staff reports, supply traffic engirleering expertise and review of traffic engineering related problems, observe and report on traffic problems and complaints, and work in close coordination with City staff to provide specialized traffic advice. The traffic engineer shall be in the total employ of SANDAG and the City shall not bear ' overhead or liability for his employment status. The City shall maintain a record of the traffic engineer's work and report monthly to SANDAG on number of hours worked. The specific hours of work shall be set by the City Engineer in consultation with SANDAG and the traffic engineer to allow flexibility in meeting the mutual commitments of the involved agencies. The City agrees to indemnify and hold harmless SANDAG, its officers, agents, and employees against any md all clairns, demands, damages, expenses, actions, liabilities or losses which may arise from, or be incurred as a result of, injury or damage to persons or property in connection with the performance of traffic engineer under this agreement, pro- vi<ed, however, that City's obligation under this paragraph shall be limited to the extent that SANDAG is required by the employment agreement between SANDAG and traffic engineer to indemnify and hold harmless traffic engineer. The City shall compensate SANDAG for services performed upon billing by SANDAG. This agreement may be terminated by either party giving written 30-day notice. This agreement shall become effective upon July 1, 1983, and supersede any prior in- formal arrangement. IN WITNESS WHEREOF, we have hereunto set our hands and seals.
