HomeMy WebLinkAbout1983-09-20; City Council; Resolution 73501 2 3 4 5 6 7 8 9 ZC 11 12 12 14 1: 16 17 1E 15 2( 21 22 22 24 2: 2( 2: 2E RESOLUTION NO. 7350 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, QUITCLAIMING AN INTEREST IN AN EASEMENT OVER A PORTION OF TRACT 54 OF HOTALING LANDS IN THE CITY OF OCEANSIDE WHEREAS, a waterline easement over a portion of Tract 54 of Hotaling Lands in the City of Oceanside was dedicated to the City of Carlsbad per an easement description recorded March 14, 1915 per San Diego County record book No. 672, Page 362 in the Book of Deeds. WHEREAS, that waterline easement previously dedicated is not needed and has not been used for the past five years. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. The above facts are true and correct. 2. That, pursuant to Section 8333 of Chapter 4, Summary Vacation, of the California Streets and Highways Code, said easement referenced above and more particularly described on Exhibit "A" attached hereto and by this reference incorporated herein, be summarily vacated. PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council of the City of Carlsbad, held the 20thday of Septexber 1983 - by the following vote to wit: AYES: Council Members Casler, Lewis, Chick and Prescott NOES: None ABSENT: Council 14atIx?r Kulckin ATTEST: (SEAL) EXHIBIT "A" Those portions of the 20 foot waterline easement recorded March 14, 1915, in Book 672, Page 352 in the Book of Deeds that is located within the following described property. All that portion of Tract 54, HOTALING LANDS, San Diego County, State of California, as shown oh'Map thereof No. 1717, filed for record April 16, 1921, in the Office of the Recorder of said San Diego County,, described as follows: Beginning at a coccrete monument marking the Point of Intersection of the prolongation of the Northeasterly boundary line of said Tract 54 with the center line of Grandv-iew Street; thence North 35'11'45" * West along said Northeasteriy boundary line, a distance of 325.85 feet, more or less, to the North line of said Tract, (Record North 35'12' West, 326.02 feet); thence South 89'48' West along the Northerly boundary line of said Tract 54, a distance of 1155.50 feet to the Point of Intersection of said Northerly boundary line with the Southerly line of the A.T. & S.F. right of- wsy, (Record South 89'37'49" West, 1144.65 feet); thence South 59'51'30" West along said Southerly right of way line, a distance of 847.29 feet, (Record South 59'49'15" West) to a point; thence South 27'57'25'' East, a distance of 1499.34 feet to a pofnt in the center line of Grandview Street; thence-along the center line of' Grandview Street the following courses and distances: First, along the arc of a curve, concave to the Northwest having a radius of 256.80 feet through a central angle of 78"21'10", a distance of 351.18 feet -lo a point of reverse curve; Second, along the arc 'of a curve, concave to the Soutfieast having a radius of 865.94 feet through a central angle of 38"13', a distance of 577.59 feet to Intersection of the center line of Ridgeway Street with the center line of Grandvi'ew Street; Fourth, North 54'48'15" East, a distance of 884.87 feet, (Record North 54'48' -3 a point; Third, North 42'27' East, a distance of 300.00 feet to the Point of *~ East, 885 feet} to the Point of Beginning. r, ., EXCEPTING THEREFROM that portion lying within Grandview Street. Also that portion of the North Half of the Northeast Quarter of Section 25, Township 11 South, Range 5 West, San Bernardino Base and Meridian, in the City of Oceanside, County of San Diego, State of California, according to United States Government Survey approved December 27, 1870, lying Southerly of the Southerly line of the right of way of Escondido Branch of Atchison, Topeka & Santa Fe Railway, and Westerly of the Westerly line of that certain street described in the Deed from William P. Downs, el; al, to the City of Oceanside, dated August 1, 1933, and recorded August 23, 1933, in Book 237, Page 74 of Official Records, in the Office of the County Recorder of San Diego County, and commonly known as Crouch Street. -. .. .. ..
