HomeMy WebLinkAbout1983-10-18; City Council; Resolution 73771 2 3 4 fi U E 'i E z 1( 1: 1: 1: 1d 1, 1 1 1 1 2 2 2 2 2 2 2 2 2 RESOLUTION NO. 7377 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AN AMENDMENT TO A TENTATIVE TRACT MAP (CT 77-8) AND CONDOMINIUM PERMIT (CP-45) CONDOMINIUM ON PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF EL CAMINO REAL IMMEDIATELY NORTH OF DOVE LANE. APPLICANT: D, S. L, SERVICES CASE NO: CT 77-8(B)/CP-45 TO ALLOW PHASING OF A 60 UNIT WHEREAS, on September 14, 1983, the Carlsbad Planning Commission adopted Resolution No. 2171 recommending to the City Council that an amendment to Tentative Tract Map (CT 77-8(B)) and Condominium Permit (CP-45) be approved; and WHEREAS, the City Council of the City of Carlsbad, on October 11, 1983, held a public hearing to consider the recommendations and heard all persons interested in or opposed to the amendment to Tentative Tract Map (CT 77-8(B)) and Condominium Permit (CP-45); and WHEREAS, said Tentative Tract Map and Condominium Permit have been declared exempt from environmental review per Section 19.04.070 of the Carlsbad Environmental Ordinance; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: A. That the above recitations are true and correct. B. That said Tentative Tract Map, together with the provisions -x its design and improvement and subject to the conditions of this resolution, is consistent with all applicable general and specific plans of the City of Carlsbad. D. That Tentative Tract Map CT 77-8(B) and Condominium Permit CP-45 are hereby approved subject to all applicable requirements of the Carlsbad Municipal Code and to the satisfaction of the conditions contained in Planning Commission Resolution No. 2171, dated September 14, 1983 marked Exhibit A, attached hereto and made a part hereof. PLANNING COMMISSION RESOLUTION NO. 2171 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING AN AMENDMENT TO A TENTATIVE TRACT MAP TO ALLOW PHASING OF A 60-UNIT CONDOMINIUM PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF APPLICANT: D. S. L. SERVICES ON EL CAMINO REAL IMMEDIATELY NORTH OF DOVE LANE. CASE NO: CT 77-8(B)/CP-45 I?' 18 WHEREAS, a verified application for certain property, to t by law, to consider said request; and WHEREAS, at said public hearing, upon hearing and A Portion of the west half of the northeast quarter of Section 26, Township 12 south, Range 4 west, San Bernardino Meridian, in the County of Sari Diego, State of 24' 25 California, I (A) That the foregoing recitations are true and correct. 11 has been filed with the City of Carlsbad, and referred to the I/ 26 27 12 I/ Planning Commission; and I //// WHEREAS, said verified application constitutes a request I 1411 as provided by Title 21 of the,Carlsbad Municipal Code; and 15 I/ WHEREAS, the Planning Commission did, on the 14 day of I 16 II September, 1983, hold a duly noticed public hearing as prescribed I 20 /I desiring to be heard, said Commission considered all factors .zl\l relating to the Tentative Tract Map and Condominium Permit; and I 22 /I NOW, THEREFORE, BE IT HEREBY FESOLVED by the Planning 23 I/ Commission as follows: I . 1 2 3 .4 E 9 1c 13 12 12 14 1E 1( 2: 24 2: 2t 2; 2E (B) That based on the evidence presented at the public hearing, the Commission hereby APPROVES CT-77-8 (B)/CP-45, based on the following findings and subject to the following conditions: Findinqs: 1) That the phasing of this project is consistent with the General Plan since the entire project, as well as Phase I is within the density range specified for the site. 2) That all required parking, recreation area, and other development standards required for Phase I by the planned development ordinance will be constructed in this phase. That the Land Use Planning Manager has determined this project to be categorically exempt from environmental review per Section 19.04.070 of.the Carlsbad Environmental Ordinance. 3) Conditions: 1) Approval is granted for CT 77-8(B)/CP-45 as shown on Exhibits "A" and "B" dated August 19, 1983, incorporated by reference and on file in the Land Use Planning Office. Phasing shall occur as shown on these exhibits. incorporated herein by reference and shall be complied within their entirety unless otherwise noted herein. 2) All conditions of approval for CT 77-8(A)/CP-45 are PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held on the 14 day of September, 1983, by the following vote, to wit: AYES : Chairman Schlehuber, Commissioners Rombotis, NOES : None . Marcus, Lyttleton, Farrow, Friestedt and Rawlins. ABSENT: None. _ABSTAIN: None.
