HomeMy WebLinkAbout1983-12-06; City Council; Resolution 74138 + 1 2 3 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 7413 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSRAD, CALIFORNIA, RECITING THE FACT OF A SPECIAL MUNICIPAL ELECTION HELD IN SAID CITY ON THE 8th DAY OF NOVEMBER, 1983, DECLARING THE RESULTS THEREOF AND SUCH OTHER MATTERS AS ARE REQUIRED BY LAW. WHEREAS, a Special Municipal Election was held and conducted in the City of Carlsbad, County of San Diego, State of California, on Tuesday, the 3th day of November, 1983, as required by law; and WHEREAS, pursuant to Resolution Nos. 7323, 7324 and 7334, said election was consolidated with the Statewide General Election held on said date; and WHEREAS, notice of said election was duly and regularly given in time, form and matter as provided by law, that voting precincts were properly established, that election officers were appointed, and that in all respects said election was held and conducted and the votes cast thereat, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections' Code of the State of California for the holding of elections in cities; and WHEREAS, City Council Resolution No. 7324, adopted on the 2nd day of August, authorized the Board of Supervisors of the County of San Diego to canvass the returns of said election; and WHEREAS, pursuant to the Election's Code said canvass has been completed by the Registrar of Voters, who has conducted the canvass, and has provided a certificate with the results of the canvass, said certificate is listed as Exhibit "A", on file with the City Clerk. 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 NOW, THEREFORE, the City Council of the City of Carlsbad, California, does resolve as follows: 1. That the above recitations are true and correct. 2. That said Special Municipal Election was held for the purpose of submitting the following measure to the electors of said City, to wit: "DO the voters of the City of Carlsbad approve spending $15.2 million dollars to build a Public Safety and Service Center on City owned land? The center will include police and fire headquarters, shops and service yards, parking, offices, a purchasing warehouse and fire station. This measure does not authorize any new taxes nor increase any existing taxes. No phase of construction will be started unless sufficient funds are on hand." 3. That the whole number of votes cast in said City was 6,252. 4. That the measure voted upon at said election is as follows: "DO the voters of the City of Carlsbad approve spending $15.2 million dollars to build a Public Safety and Service Center on City owned land? The center will include police and fire headquarters, shops and service yards, parking, offices, a purchasing warehouse and fire station. This measure does not authorize any new taxes nor increase any existing taxes. No phase of construction will be started unless sufficient funds are on hand. 5. That the number of votes given at each precinct for and against the measure, were as listed on Exhibit "B" on file with the City Clerk. 6. The City Council does declare and determine that: That as as a result of said election, a majority of the qualified voters voting on said measure relating to a public safety center did vote in favor thereof, and that said proposition was carried, and shall be deemed approved. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the file of Original Resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
