HomeMy WebLinkAbout1983-12-06; City Council; Resolution 74200 RESOLUTION NO. 7420 A RESOLUT ON OF THE CITY COUNCIL OF THE CITY F CARLSBAD, CALIFORNIA TO DENY AN APPEAL AND UPHOLD THE PLANNING COMMISSION'S DENIAL OF THREE PROPOSED AMENDMENTS OF THE LAND USE ELEMENT OF THE GENERAL PLAN - GPA 70(A) ALANDA; GPA/LU 83-9 TRUITT AND GPA/LU 83-13 KOBLENTZ. WHEREAS, the Planning Commission did on October 12 and October 26, 1983 hold duly noticed public hearings as prescribed by law to consider amendments to the Land Use Element of the General Plan GPA 70(A); GPA/LU 83-9; and GPA/LU 83-13; and WHEREAS, the Land Use Planning Manager and the Planning Commission have determined that amendments GPA/LU 83-13 and GPA/LU 83-9 will not have significant impacts on the environment and Negative Declarations have been prepared and filed, and EIR 83-5 was certified for GPA70(A) all in satisfaction of the requirements of the City of Carlsbad Environmental Protection Ordinance of 1980 and the California Environmental Quality Act; and WHEREAS, the City Council did on November 15 and November 22, 1983 hold duly advertised public hearings to consider said amendments and at said time received the recommendations, objections, protests and comments of all interested persons desiring to be heard; and WHEREAS, the City Council, after considering these and other proposed changes to the Land Use Element of the General Plan, directed the City Attorney to return with appropriate documents to allow the City Council to vote on the changes individually as a part of one single amendment to the Land Use Element of the General Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: 1. That the above recitations are true and correct. 2. That this resolution and resolutions no. 7018 , 7419 , and 7421 , constitute a single amendment to the Land Use Element of the General Plan. 3. That the findings of the Planning Commission as set forth in Planning Commission Resolutions No. 2197 (GPA/LU 83-9); 2193 (GPA 70(A)); and 2201 (GPA/LU 83-13) constitute the findings of the City Council. 4. That the City Council hereby denies the appeal of Koblentz and upholds the decision of the Planning Commission to deny a change in the land use designation from Neighborhood/Commercial to Residential/Medium/High Density (RMH 10-20) on eight acres of property generally located on the southwest side of Paseo del Norte at Camino Del Parque, as shown on the map marked Exhibit A, attached hereto and made a part hereof. 5. That the City Council hereby denies the appeal of Truitt and upholds the decision of the Planning Commission to deny a change in the land use designation from Residential/Low/ Medium (RLM 0-4) to Residential/High (RH 20-30) on property generally located on the south side of Tamarack Avenue between Hibiscus Circle and the AT&SF Railroad, as shown on Exhibit B, attached hereto and made a part hereof. 6. That the City Council hereby denies the appeal of Alanda and upholds the decision of the Planning Commission to deny a change in the land use designation from 13 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Residential/Medium (RM 4-10) to Residential/Medium/High (RMH 10- 20) on property generally located on the northwest corner of El Camino Real and future Elm Avenue, as shown on Exhibit C, attached hereto and made a part hereof. 7. Actions number 5 and 6 are taken without prejudice to the applicant's rights to reapply at another time.
