RESOLUTION NO. 7438
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, MAKING THE FINDING
THAT THE HOERNLEIN STORM DRAIN PROJECT DOES
NOT HAVE TO COMPLY WITH THE PUBLIC CONTRACT
CODE.
WHEREAS, the City Counicl of the City of Carlsbad,
California, has determined that it is necessary and in the public
interest to construct the Hoernlein Storm Drain; and
WHEREAS, the City Clerk of said City had advertised said
Storm Drain for bids per Municipal Code, Section 3.28.080; and
WHEREAS, no bids were received for said Storm Drain;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad as follows:
1. The above recitations are true and correct.
2. The Hoernlein Storm Drain Project is to be continued to
its completion.
3. The Public Contract Code governing bids for Public Work
no longer needs to be complied with for said Storm Drain.
4. The City Manager enter into the necessary contract to
complete the storm drain construction using monies previously
a1 located by Counci 1.

Council of the City of Carlsbad held on the 20th day of
December , 1983, by the following vote, to wit:
