The City Council of the City of Carlsbad, California ceby resolves as follows: 1. All tape recordings of telephone and radio nmunications made by the public safety communications center Dlice and fire communication and dispatch) may be destroyed by use of the tape or otherwise after 100 days from the day the cording was made . 2. A written summary log of telephone and radio mmunications shall be kept for the period of time otherwise quired by law. 3. If the police or fire department are notified ring the 100 day retention period that a recording is evidence any claim filed or any pending litigation such recording all be preserved until the pending claim or litigation is solved. When the recording to be preserved is a portion of a ped record the recording may be preserved by recording the rtion onto another tape and by preparation of a written anscript of the preserved portion. When presentation is quested by persons or entitees other than the City or fendants in criminal actions a fee not to exceed the actual 1st of preserving the recording shall be paid by the personal itity requesting the preserved record. 4. This authorization is given pursuant to section 1090.6 of the Government Code and is valid until revoked.
