That certain agreement between the City of Carlsbad and the Can-lsbad Athletic Recreation Association for use of property leased from Carlsbad Research Center, a copy of which is attached hereto marked Exiibit "A" and made a part hereof , is hereby approved. 2. That the Mayor of the City of Carlsbad is hereby authorized directed to execute said agreement for and on behalf of the City of s bad e PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council the City of Carlsbad, California, held on the - 1st day of May , 1984, the following vote, to wit: AYES: NOES: None @unci1 Members Casler, Lewis, Chick and Prescott RESOLUTION NO. 7594 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AN AGREEMENT BETWEEN THE CITY OF CARLSBAD AND THE CARLSBAD ATHLETIC RECREATION ASSOCIATION FOR USE OF PROPERTY LEASED FROM THE CARLSBAD RESEARCH CENTER AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT. &TEST: SEAL 1 3 AGREEMENT BETWEEN THE CITY OF CARLSBAD AND THE CARLSBAD ATHLETIC RECREATION ASSOCIATION FOR THE USE OF THE TEMPORARY SOFTBALL FACILITY AT LOT 18 AND 19 OF THE CARLSBAD RESEARCH CENTER This algreement is made and entered into this day of communityg WHEREqS, leagues ii WHEREAS, the Carlsbad 1984, by dnd between the City of Carlsbad, a municipal corporation, and the C.A.R.A. organization is composed of all the youth Carlsbad; and the City has leased Lot 18 and 19 of Map No. 10330 from Research Center to provide a temporary athletic facility hereinaftelr referred to as l1City” and the Carlsbad Athletic Recreation for C.A.R.A. The City will be responsible uling the facility. C.A.R.A. will install the temporary wooden backstop which will at C.A.R.A.’s expense when the agreement expires. C.A.R.A. will be responsible for the maintenance of the field surrounding area to the satisfaction of the Parks and Director. The City will provide trash cans at the site. The City or the search Center can terminate this agreement at any time. sofar as it is legally authorized, C.A.R.A. shall hold free s City, members of City Council, Boards or Commissions, its officers, costs, expenses or liability which may arise by iability imposed by law because of injury to or death of eived or suffered because of injury to property or injury to person, received or suffered by reason or any defective or ondition on any ground, site, equipment, or other located on the premises leased by the City and by reason of the recreational programs upon said premises and, the C.A.R.A. shall be responsibile for any and all damages to caused as a direct result of any recreational activity being on said premises by C.A.R.A.
