RESOLUTION NO. 7641
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA AUTHORIZING THE MAYOR TO EXECUTE
FOR THE OPERATION AND MAINTENANCE OF THE ENCINA WATER POLLUTION CONTROL FACILITY.
THE TWENTY-NINTH SUPPLEMENT TO THE BASIC AGREEMENT
WHEREAS, the Eleventh Supplement to the Basic Agreement established
rehneration to the attendees of the Joint Advisory Committee (JAC) at
$25.00 per meeting with a $50.00 per month maximum payment, and;
WHEREAS, it is the recommendation of the JAC that these fees be increased
to $50.00 per meeting with a $100.00 per month maximum;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad as follows:
1. That the above recitations are true and correct.
2. Section 1 That the Mayor of the City of Carlsbad is hereby authorized
to execute the Twenty-Ninth Supplement to the Basic Agreement relating to the
Encina Joint Sewer System.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
Council held the 19th day of June , 1984, by the following vote, to wit:

This Twenty-Ninth Supplement is made and entered into this
day of >fay, 1984, by and among the CITY OF VISTA ("VISTA"),
the CITY OF CARLSBAD ("CARLSRAD"), the LEUCADIA COUNTY WATEK
DISTRICT ("LEUCADIA") , the RUENA SANITATION DXSTRICT ("BUENA") ,
the SAN MARCOS COUNTY WATEK DISTRICT ("SAN NARCOS"), and the
EFCINITAS SANITARY DISTRICT ("ENCINITAS") . ._
Recitals
A. The aforesaid parties to this agreement are parties to a
joint powers agreement dated July 13, 1961, for the acquisition
and construction of a joint sewer system presently known as the
ENCINA WATER POLLUTION COKTROL FACILITY ("EWPCF"). Said agree-
ment is known as and referred to herein as the "Basic Agreement."
B. Said Basic Agreement has heretofore been supplemented
and amended by written agreement among all parties hereto'
C. The Eleventh Supplement to the aforesaid Basic Agreement
provides in part that members or alternate members of the Joint
Advisory Committee who attend meetings will be paid $25.00 per
meeting with a maximum of $50.00 per month to any one person.

D. It is the desire and intent of the parties hereto to
increase said amount from $25.00 per meeting to $50.00, and from
a maximum of $50.00 in any one calendar month to $100.00.

E. This Twenty-Ninth Supplement to the Basic Agreement is
made pursuant to the provfsions of Article 1, Chapter 5, Division
7, Title 1 of the Government Code of the State of California,
commencing with Section 6500 relating to the joint exercise of
powers common to public agencies; in this case being CARLSBAD,
VISTA, BUENA, SAN MAKCOS, LEUCADIA, and ENCINITAS, each of which
is authorized to contract with the other pursuant thereto.
NOW, THEREFORE, the parties hereto agree as follows:
1. Section 15 of the Eleventh Supplement to the Basic
Agreement is hereby amended to read as follows:
"SECTION 15: The operator shall pay each representative of the Joint Advisory Committee (or alternate who attends a meeting of the Joint Advisory Committee and/or of any sub- committee of said Joint Advisory committee by reason of the
temporary absence of a representative) an attendance fee of Fifty Dollars($50.00) for each meeting of the Joint Advisory
Committee or any subcommittee meeting attended, provided that the maximum payable hereunder to any one person is One Hundred Dollars ($100.00) for attendance of such meetings in any one calendar month. Nothing herein shall preclude any party hereto from making payment directly to its representa- tive or alternate representative of the Joint Powers for attendance at any meeting of the Joint Advisory Committee. Provided any party pays its representative directly, such payment shall be in lieu of any payment that would otherwise be required to be made hereunder by the operator. The cost
of any supplies and help furnished the Joint Advisory Com- mittee or any subcommittee thereof by the operator and any attendance fees shall constitute a part of the total expen- ses of maintaining and operating the Joint System and shall be paid as hereinabove provided for the payment of operation and maintenance costs of the said Joint System."

2. As herein modified, .the Eleventh Supplement to the
Basic Agreement shall remain in full force and effect until
further changed by the parties hereto.
3. This Twenty-Ninth Supplement to the Basic Agreement may
be executed in counterparts, and upon execution thereof by the
parties hereto, each counterpart shall be deemed an original.

IN WITNESS WHEREOF, each party hereto has caused this Agree-
ment to be signed by its respective ofEicfals heretofore duly
authorized by the legislative bodies thereof.
