HomeMy WebLinkAbout1984-08-21; City Council; Resolution 7717RESOLUTION NO. 7717 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING THE LAND USE ELEMENT OF THE GENERAL PLAN TO CHANGE THE LAND USE DESIGNA- TIONS FOR TWO AREAS OF THE CITY'S GENERAL PLAN, GPA/LU 83-14 CARLSBAD LAND INVESTORS AND GPA/LU 84-3 ALANDA AND DENYING A CHANGE GPA/LU 84-4 ROBERTSON. WHEREAS, the Planning Commission did on April 25 and June 27, 1984 hold duly noticed public hearings as prescribed by law to consider amendments to the Land Use Element of the General Plan GPA/LU 84-3, GPA/LU 83-14 and GPA/LU 84-4; and WHEREAS, the Planning Commission has determined that GPA/LU 84-4 would not have significant impacts on the environment and a Negative Declaration was approved on June 27, 1984, and the City Council certified EIR 83-8 for GPA/LU 83-14 on June 5, 1984, and a notice of prior compliance issued April 4, 1984 for GPA/LU 84-3 all in satisfaction of the requirements of the City of Carlsbad Environmental Protection Ordinance of 1980 and the California Environmental Quality Act; and WHEREAS, the City Council did on June 5, July 17 and August 7, 1984 hold duly advertised public hearings to consider a series of amendments and at that time received the recommendations, objections, protests and comments of all interested persons desiring to be heard; and WHEREAS, the City Council, after considering all proposed changes to the Land Use Element of the General Plan, directed the City Attorney to return with appropriate documents to allow the City Council to vote on the changes as a part of on( single amendment to the Land Use Element of the General Plan. /// a NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: 1. That the above recitations are true and correct. 2. That this resolution constitutes a single amendment to the Land Use Element of the General Plan. 3. That the findings of the Planning Commission as set forth in Planning Commission Resolutions No. 2282 (GPA/LU 84-3) and 2316 (GPA/LU 83-13) constitute the findings of the City Council but that the findings of No. 2314 (GPA/LU 84-4) are not approved. 4. That the Land Use Element of the General Plan is amended as follows: A. GPA/LU 84-3 ALANDA: To change the Land Use Element designation from R-M, 4-10 DU's per acre to RMH, 10-20 DU's per acre on 9 acres of property located on the northwest corner of El Camino Real and future Elm Avenue as shown on the map marked Exhibit A, April 25, 1984, GPA/LU 84-3, attached hereto and made a part hereof. B. GPA/LU 83-14 CARLSAD LAND INVESTORS: To change the Lnad Use Element designation from R-4, 0-1.5 DU's per acre to RLM, 0-4 DU's per acre on 85 acres of property located south of Palomar Airport Road east of Laurel Tree Lane as shown on the map marked Exhibit A, 6-27-84, GPA/LU 83-14 attached hereto and made a part hereof. 5. That the request of Robertson GPA/LU 84-4 to amend the Land Use Element of the General Plan from RM and RLM to C is denied. 20 21 22 23 24 25 26 27 28 a 0 i PASSED, APPROVED AND ADOPTED at a regular meeting of th City Council of the City of Carlsbad, California, held on the 21st day of August , 1984, by the following vote, to wit: AYES : Council &&nbers Casler, Zewis, Kulchin, Prescott NOES: None ABSENT: Council Wmkr Cbick ATTEST: ALETHA L.
