APPLICANT: CARLSBAD OFFICE CENTER CASE NO: CT 84-17/CP-287 WHEREAS, a verified application for certain property, to Parcel 1 in the City of Carlsbad, County of San Diego, State of California, as shown on Parcel Map No. 2568, recorded in the Office of the County Recorder of San Diegc County on April 19, 1974. A.P.N. 203-354-14, filed with the City of Carlsbad, and referred to the City and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the City Council did, on the 21st day of August, 1984, hold a duly noticed public hearing as prescribed by law, to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Council considered all factors relating to the Tentative Tract Map and Condominium Permit; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council as follows: (A) That the foregoing recitations are true and correct. (B) That based on the evidence presented at the public hearing, the Council APPROVES CT-84-17/CP-287, based on the following findings and subject to the following conditions: Find ings : 1) The project is consistent with the goals and design standards of the Village Design Manual. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 The project is located in an existing building which presently has sewer hookups. The project is consistent with all City public facility pol- icies and ordinances since: a) All necessary public improvements have been provided or will be required as conditions of approval . b) The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the general plan. The proposed project is categorically exempt from environmental review and a Notice of Exemption was filed by the Land Use Planning Manager on June 18, 1984. Conditions: Approval is granted for CT 84-17/CP-287, as shown on Exhibits "A" - "E", dated May 3, 1984, incorporated by reference and on file in the Land Use Planning Office. Development shall occur substantially as shown unless otherwise noted in these conditions, This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated April 2, 1982, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee, a copy of that agreement, dated, January 24, 1984 is on file with the City Clerk and incorporated herein by reference. If said fee is not paid as promised, this application will not be consistent with the General Plan and approval for this project shall be void. The applicant shall give notice of the conversion to all tenants as required by the Subdivision Map Act and the Carlsbad Municipal Code. Land Use Planning Conditions: 4) The applicant shall establish a owner's association and corresponding covenants, conditions and restrictions. Said CC&R's shall be submitted to and approved by the Land Use Planning Manager prior to final map approval . 5) All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. //// -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Any signs proposed for this development shall be designed in conformance with the City's Sign Ordinance and shall require review and approval of the Land Use Planning Manager prior to installation of such signs. Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Land Use Plannin! Manager . All roof appurtenances, including air conditioners, shall be architecturally integrated and shielded from view and the sound buffered from adjacent properties and streets, pursuant to Building Department Policy No. 80-6, to the satisfaction 0: the Land Use Planning Manager and Building and Planning Director. Engineering Conditions: Approval of this tentative tract map shall expire twenty-four months from the date of City Council approval unless a final map is recorded. An extension may be requested by the applicant. Said extension shall be approved or denied at the discretion of the City Council. In approving an extension, the City Council may impose new conditions and may revise existing conditions. Prior to final map approval the developer shall repair any broken or uplifted sidewalks adjacent to the project to the satisfaction of the City Engineer. Prior to final map approval the developer shall complete all necessary improvements on the property to bring the existing building into conformance with state and city requirements regarding handicap access. Pursuant to the provisions of Section 20.20.050(1) of the Carlsbad Municipal Code, a parcel map may be filed in lieu of a final map. Whenever reference is made in these conditions to a final map, the reference shall apply also to a parcel ma] filed in lieu thereof. Building Department Conditions: 13) All lavatory facilities shall be improved and upgraded to the satisfaction of the Building Office or prior to final map approval . Parks and Recreation Conditions: 14) The applicant shall fill in the ground cover along the front of the building to match the existing material to the satisfaction of the Director of Parks and Recreation prior to final map approval. -3- 1 2 3 4 5 6 7 8 9 3.0 21 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 The applicant shall add trees and shrubs and irrigation as necessary along the north building elevation. The applicant shall submit the type, quantity and size to the Director of Parks and Recreation for approval. This shall be accomplished prior to final map approval. The applicant shall add a raised planter between the service station parking lot, south of the site, and the subject officf parking lot. In this island they shall plant trees, shrubs and ground cover and irrigate as necessary. A plan showing planting selections shall be approved by the Director of Parks and Recreation. This shall be accomplished prior to final may approval.
