HomeMy WebLinkAbout1985-04-16; City Council; Resolution 79821 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. ,7982 A RESOLUTION IN SUPPORT OF SENATE BILL 433 (BERGESON) WEREAS, Senator Rergeson has introduced S5 433, amending Section 831.2 of the Government Code, relating to public liability; and WHEREAS, State law provides that a city or other public entity is immune from liability for injuries caused by the natural condition of unimproved public property; and WHEREAS, a non-natural condition is created when a city provides public services related to the property; and WHEREAS, many claims are pending against a number of cities related to non- natural conditions in lakes, streams, bays, rivers or beaches. WHEREAS, it is in the best interest of the citizens of Carlsbad, California and throughout the state, to extend immunity to a city or other public entity when services are provide or improvements are made on unimproved public property . NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Carlsbad supports SB 433 - Bergeson - and urges its passage. PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council of the City of Carlsbad held on the 16th day of Wril , 1985, by the following vote, to wit: AYES: Council mtbrs Lewis, Kulchin, Chick and Pettine NOES: "-E ABSENT: Council i%-rber Casler ATTEST: CLAUDE A.
