HomeMy WebLinkAbout1985-08-27; City Council; Resolution 8154f- 1 2 3 4 5 6 7 e 9 1c 11 12 12 14 15 16 17 If 1s 2c 21 22 22 24 2E 26 27 2E RESOLUTION NO. 8154 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CONVENIENCE, AND NECESSITY REQUIRE THE ISSUANCE OF A CALIFORNIA, DETERMINING THAT THE PUBLIC INTEREST, CERTIFICATE TO EMBASSY INTERNATIONAL LIMOUSIW TO OPERATE ONE LIMOUSINE IN THE CITY OF CARLSBAD AND ORDERING THE CITY CLERK TO ISSUE SAID CERTIFICATE SUB3ECT TO CERTAIN CONDITIONS. WHEREAS, Embassy International Limousine, in accord with Chapter 5.20 of the Municipal Code has applied for a Certificate of Convenience and Necessity to operate limousine service within the City of Carlsbad; and WHEREAS, pursuant to said chapter a public hearing was held on August 27, 1985, to determine whether or not the public interest, convenience, and necessity require the issuance of the certificate applied for; and WHEREAS, at said hearing all persons having interests in the matter were heard. NOW, THERETORE, BE IT RESOLVED by the City Council of the City of Carlsbad, as follows: 1. That the above recitations are true and correct. 2. That the public interest, convenience and necessity require the issuance of the certificate applied for. 3. That said certificate is hereby issued to Embassy International , Limousine, to expire on August 31, 1986, subject to the following terms and conditions : (a) (b) One limousine vehicle is authorized. (c) The schedule of fares to be charged shall be: The certificate permits service throughout the City of Carlsbad. $40.00 per hour or $1.50 per mile, whichever is greater. (d) The certificate and the operation of limousine service pursuant thereto shall be subject to all of the provisions of Chapter 5.20 of the Municipal Code. (e) The certificate is issued to commence on the date of adoption of this resolution and to expire on August 31, 1986. /// 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 (f) Applicant's application form which is on file in the Office of the City Clerk, shall be made a part of this certificate, and is incorporated by reference herein. (9) The City shall have the right to inspect all vehicles at any vAt.ie to insure they are maintained in safe operating condition. (h) (i) Applicant may only use the vehicle listed on his application. Applicant shall file certification of insurance in the amounts of $100,000/300,000 with the City Clerk prior to commencing service pursuant to this certificate . (j) No taxi stands are permitted. 4. That the City Clerk is hereby directed to issue a copy of this resolution as a certificate in accord with Chapter 5.20 of the Carlsbad Municipal Code. 5. That the certificate shall not he issued until the applicant has complied with all of the hereinabove terms and conditions.
