HomeMy WebLinkAbout1985-09-10; City Council; Resolution 81701 2 3 4 5 6 7 E 9 1c 11 E n t 0 1t I! 2( 2: 2: 2: 21 21 2( 2' 21 RESOLUTION NO, 8170 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A 154 UNIT TENTATIVE TRACT MAP (CT 85-11) AND PLANNED UNIT DEVELOPMENT (PUD-86) ON 58.9 ACRES ON PROPERTY GENERALLY LOCATED IN NEIGHBORHOOD SE-18 NORTH OF CALLE BARCELONA APPROXIMATELY 800 FEET EAST OF THE INTERSECTION OF CALLE BARCELONA AND RANCHO SANTA FE ROAD. APPLICANT: VISTA SANTA FE (AREA "C") CASE NO: CT 85-11/PUD-86. WHEREAS, on July 10, 1985, the Carlsbad Planning Commission adopted Resolution No. 2454 recommending to the City Council that Tentative Tract Map (CT 85-11) and Planned Unit Development (PUD-86) be approved; and WHEREAS, the City Council of the City of Carlsbad, on August 20, 1985 held a public hearing to consider the recommendations and heard all persons interested in or opposed t< Tentative Tract Map (CT 85-11) and Planned Unit Development (PUD- 86); and WHEREAS, said Tentative Tract Map and Planned Unit Development have been declared to have a nonsignificant impact 01 the environment and a Negative Declaration, dated June 6, 1985, was prepared, approved and filed by the Planning Commission on July 10, 1985, in compliance with the requirements of the City of Carlsbad Environmental Protection Ordinance of 1980 and the California Environmental Quality Act: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: A, That the above recitations are true and correct. B. That the findings of the Planning Commission in Resolution No. 2454 constitute the findings of the City Council in this matter with the exception of the following additional finding: 1 2 3 4 5 6 7 8 9 10 11 12 1. Finding No. 9 is added to read as follows: "9) Pursuant to the La Costa Master Plan the City Council has considered the approval of four projects, CT 85-9, LCDP 85-1, Vista Santa Fe; CT 85-15, LCDP 85-2, Park View West; CT 85-11, PUD-86, Vista Santa Fe; and CT 85-6 PUD-80, Daon Southwest. These projects will add a substantial amount of traffic to Rancho Santa Fe Road which is already operating above its design capacity. These four projects have been conditioned with interrelated conditions insuring that Rancho Santa Fe Road will be improved from Olivenhain Road to La Costa Avenue prior tc occupancy of any of the homes within the four projects and that the City Council will determine the timing and extent of the improvements to be required for the remaining portion of Rancho Santa Fe Road between La Costa Avenue and Melrose Drive prior to final map approvals. The City Council has determined in approving these projects that the public facilities element of the general plan requires the Council to utilize its authority under the La Costa Master Plan to advance the improvement schedules for Rancho Santa Fe Road and impose these conditions because such improvements are necessary to take care of the traffic from these projects and that in the absence of construction of Rancho Santa Fe Road these projects could not be approved. C. That said Tentative Tract Map, together with the provisions for its design and improvement and subject to the conditions of this resolution, is consistent with all applicable general and specific plans of the City of Carlsbad. D. That Tentative Tract Map CT 85-11 and Planned Unit Development PUD-86 are hereby approved subject to all applicable requirements of the Carlsbad Municipal Code and to the satisfaction of the conditions contained in Planning Commission Resolution No. 2454 dated July 10, 1985 marked Exhibit A attache( hereto and made a part hereof, with the exception of the following additional conditions and revisions: 2. Condition No. 60 is revised by the addition of the following: "The limit on the amount of the fee is based on the City Engineer's estimate. Condition No. 42 is revised to read as follows: "42. Within nine months after tentative map approval, developer shall have commenced construction of the easterly half of Rancho Santa Fe Road between Olivenhain Road and Mission Estancia. Construction of these improvements to Rancho Santa Fe Road shall be completed within fifteen months from the approval of the tentative map." 4. Condition No. 57 is to be deleted. 5. Condition No. 58 is revised to read as follows: "58. Prior to final map approval, the developer shall sign an improvement agreement and bond for the easterly half street improvements at the intersection of Rancho Santa Fe Road and Olivenhain Road at the time Rancho Santa Fe Road is improved Within thirty days of the tentative map approval, the applicant shall submit an acceptable agreement with the developers of La Costa Master Plan neighborhoods SW 1, 2, 3 and 4 and SE 16 and 1 coordinating the time schedule for construction of Rancho Santa Fe Road between Olivenhain Road and La Costa Avenue. The westerly side shall be constructed first, and the easterly side second." 6. Condition No. 61 is revised to read as follows: "61. The City Council has determined that in order to accommodate the traffic from this project the developer must be responsible for the improvement of Rancho Santa Fe Road from La Costa Avenue to the existing Melrose Drive intersection. Prior to final map approval the developer shall submit a proposal satisfactory to the City Council for such improvements. The proposal shall be based on an independent traffic analysis accomplished to the satisfaction of the City Engineer. The proposal shall include a time schedule and financing plan for th improvements which may include an assessment district, developer financing, or some alternative acceptable to the City Council . The construction and improvements must be assured either by confirmation of the assessment district, secured subdivision improvement agreement, or otherwise guaranteed to the satisfaction of the City Council prior to final map approval." 7. Condition No. 71 is revised to read as follows: "71. That portion of Rancho Santa Fe Road and Olivenhain Road improved by this development shall be landscaped per the City of Carlsbad's streetscape theme as detailed in the City's Landscape Guidelines Manual." 8. Condition No. 72 has been added to read as follows: "72. APPLICANT: VISTA SANTA FE (AREA "C") CASE NO: CT 85-ll/PUD-86 CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING WHEREAS, a verified application for certain property, to wit: Portion of Lots 4 and 9 of Rancho Las Encinitas according to Map No. 848 filed June 27, 1898, has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 26th day of June, 1985, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Tentative Tract Map and Planned Unit Development. The site is physically suitable for the type and density of the development since the site is adequate in size and shape to accommodate residential development at the density pro- posed. The project is consistent with a11 City public facility pol- icies and ordinances since: The Planning Commission has, by inclusion of an appropriate condition to this project, ensured that the final map will not be approved unless the City Council finds that sewer service is available to serve the project. In addition, the Planning Commission has added a condition that a note shall be placed on the final map that building permits may not be issued for the project unless the City Engineer determines that sewer service is available, and building cannot occur within the project unless sewer service remains available, and the Planning Commission is satisfied that the requirements of the public facilities element of tkie General Plan have been met insofar as they apply to sewer service for this project . School fees will be paid to ensure the availability of school facilities in the San Dieguito school district. Also, an existing school agreement between La Costa Land Company (DAON) and the Encinitas School District will ensure adequacy of elementary school facilities. The dedication of park land or the payment of park-in-lieu fees are required as a condition of approval. All necessary public improvements have been provided or will be required as conditions of approval. The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the General Plan. Assurances have been given that adequate sewer for the project will be provided by the Leucadia County Water District. The proposed project is consistent with the development standards and regulations of the Leucadia County Water District. RES0 NO. 2454 -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 1E 1s 2c 21 22 2: 24 25 26 27 28 The proposed project is compatible with the surrounding future land uses since the properties to the south, east and west are designated for residential development on the General Plan, The proposed project and the proposed public inprovements are consistent with the La Costa Master Plan and the public Facilities phasing section of the La Costa Master Plan. The density of the prooosed 2.61 du/ac is below the mean density of 3 du/ac established for the RLM General Plan designation by City Council Policy 7872. This project will not cause any significant environmental impacts and a Negative Declaration has been issued by the Land Use Planning Manager on June 6, 1985 and approved by the Planning Commission on July 10, 1985. Zondi t ions : Approval is granted for CT 85-ll/PUD-86, as shown on Exhibits "A" - "F", dated March 8, 1985 incorporated by reference and on file in the Land Use Planning Office, Development shall occur substantially as shown unless otherwise noted in these conditions. This project is approved upon the express condition that the final map shall not be approved unless the City Council finds as of the time of such approval that sewer service is available to serve the subdivision. This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This note shall be placed on the final map , This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated April 2, 1982, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee, a copy of that agreement, dated January 22, 1985, is on file with the City Clerk and incorporated herein by reference. Water shall be provided by the Olivenhain Municipal water District. The applicant shall prepare a reproducible mylar of the final site plan incorporating the conditions contained herein. If any such condition is determined to be invalid this approval shall be invalid unless the City Council detervines that the project without the condition complies with all requirements of law. Prior to issuance of any building permits, the applicant shall submit a detailed fencing plan fcr the approval of the Land Use Planning Manager. At a minimum, solid wood or block fences shall be placed between units along side property lines from the front of the dwelling unit to the rear property lines. Said fences shall be installed prior to occupancy of the units. Prior to occupancy of any units, the applicant in cooperation with the Parks and Recreation Department and the Department of Fish and Game, shall commence work on the creation of a half acre of fresh water marshland in the open space area in the vicinity of Mision Estancia Road. This area shall be completed prior to occupancy of any unit in Phase Five. Following completion this area shall be left in its natural state. Prior to issuance of any building permits, the applicant shall submit a detailed landscape and maintenance plan for the open space lot and the future school lot, Said plan shall include a meandering trail system with rest stops as specified by the La Costa Master Plan. Said trail system and rest stops shall be installed prior to occupancy of any units. This plan shall include express provisions for the open space area adjacent to Rancho Santa Fe Road which shall be heavily wooded, This landscaping shall be installed prior to the occupancy of any units in Phase Four. Any signs proposed for this development shall be designed in conformance with the City's Sign Ordinance and the La Costa Master Plan and shall require the approval of the Land Use Planning Manager prior to the installation of such signs. Prior to occupancy of any unit in Phase 5 or prior to the next General Plan Amendment hearing, the applicant shall file a General Plan Amendment to redesignate the school site, Lot 158 to 0-S/G, Open Space/Governmental. All garages shall have a minimum interior dimension of 20 feet. Lots that do not have sufficient area to provide a level rearyard with a minimum dimension of 15 feet shall provide a deck with a minimum width of 10 feet across the entire width of the dwelling unit. The owner of the subject property shall execute a hold harmless agreement regarding drainage across the adjacent property prior to approval of the final map for this project. The drainage system shall be designed to ensure that runoff resulting from a 10-year frequency storm of 6 hours or 24 hours duration under developed conditions, is equal to or less than the runoff from a storm of the same frequency and duration under existing developed conditions. Both 6 hour and 24 hour storm durations shall be analyzed to determine the detention basin capacities necessary to accomplish the desired results, Prior facilities may satisfy this requirement. The developer shall make an offer of dedication to the City for all public streets and easements required by these conditions or shown on the Tentative Map. The offer shall be made by a Certificate on the Final Map for this project, All land so offered shall be granted to the City free and clear of all liens and encumbrances and without cost to the City. The subdivider shall conform to Section 20.16.095 of the Carlsbad Municipal Code. All plans, specifications, and supporting documents for the improvements of this project shall be signed and sealed by the Engineer in responsible charge of the work. Each sheet shall be signed and sealed, except that bound documents may be signed and sealed on their first page. The men t agreement //// PC RES0 NO. 2454 -10- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Developer shall, prior to final map approval, enter into an agreement with the City for the developer to pay a traffic impact fee for the developer's share of mitigating anticipated future traffic problems at and near the intersection of El Camino Real and Olivenhain Road, and at or near the intersection of El Camino Real and La Costa Avenue. The interim fees to be collected, at the time of building permit issuance, shall not exceed $250 per single family housing unit, nor $200 per multiple family housing unit. The amount of such fees shall be determined by the City Council based on an area traffic impact study to be undertaken by the City and concluded within six months after approval of applicant's tentative tract map. Prior to final map approval, developer shall agree to participate in an assessment district to finance the . construction and/or reconstruction of Rancho Santa Fe Road from La Costa Avenue to Melrose Avenue. A letter from the applicant, to the satisfaction of the City Attorney, agreeing to participate in this assessment district shall satisfy this requirement. Fire Department Conditions: Additional public and/or onsite fire hydrants shall be provided if deemed necessary by the Fire Marshal. The applicant shall submit two (2) copies of a site plan showing locations of existing and proposed fire hydrants and onsite roads and drives to the Fire Marshal for approval. An all-weather access road shall be maintained throughout construction. All required fire hydrants, water mains and appurtenances shall be operational prior to combustible building materials being located on the project site. Brush clearance shall be maintained according to the specifications contained in the City of Carlsbad Landscape Guidelines Manual. All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent to the project shall be submitted to the Fire Department €or approval prior to construction. Prior to occupancy of any units, a 500 scale map of the subdivision shall be submitted to the Fire Department. Prior to occupancy of any units, the proposed subdivision shall be served by a water main system with a second point of access, other than the Calle Barcelona/Rancho Santa Fe Road intersection.
