RESOLUTION NO. 8229
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAHLSBAD, CALIFORNIA, SUMMARILY VACATING A RIGHT-
OF-WAY EASEMENT OVER A PORTION OF PASEO DEL NORTE [
WHEREAS, the above street right-of-way, as described in
Exhibit A and Exhibit B attached hereto and by reference made a
part hereof, previously dedicated will provide no useable
access to the adjoining properties after the realignment of
Paseo Del Norte.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That, pursuant to Section 8330a of Chapter 1050 of
the California Street and Highway's Code, said easement
referenced above, be summarily vacated to the underdlying
interest holder.
3. That the reasons for the vacation are:
a. The right-of-way has been superseded by an
alternate right-of-way.
b. It is excess right-of-way no longer needed for
roadway purposes.
4. That the City Clerk is hereby authorized to cause
this resolution, including Exhibit A (Legal Description) and
Exhibit B (Plat of Legal Description) attached hereto and made a
part hereof, to be recorded in the Office of the County
Recorder of San Diego County, State of California.

the Carlsbad City Council held on the 15th day of October - ?
1985 by the following vote, to wit:
AYES: Council Members Casler, Lewis, Kulchin, Chick and Pettine
NOES: None

That portion of the 86.00 foot Public Road Easement known as
Paseo Del Norte as Granted to the City of Carlsbad per document
recorded November 30, 1972 as File No. 72-320457 as shown within
Parcels 2 and 3 of Parcel Map No. 11284, said map filed in the .
Office of the County Recorder of San Diego County on May 11,.
1981, also including the 10.00 foot Landscape and Utility
Easement lying within said Parcels 2 and 3 as granted to the City
of Carlsbad per the above mentioned document.
NOTE: EASEMENTS FOR ALL UTILITIES OYER, UNDER AND ACROSS SAID
PARCELS 2 AND 3 OF PARCEL MAP NO. 11284, SHALL BE PREPARED BY THE
CITY OF CARLSBAD.
