HomeMy WebLinkAbout1986-03-04; City Council; Resolution 8427RESOLUTION NO. 8427 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING THE LAND USE ELEMENT OF THE GENERAL PLAN TO CHANGE THE LAND USE DESIGNA- TIONS FOR THREE AREAS OF THE CITY'S GENERAL PLAN AND TO CHANGE THE TEXT TO IMPLEMENT THE REVISED DENSITY CALCULATIONS FOR OPEN SPACE GPA/LU 85-7 - CITY OF CARLSBAD (LA CORUNA PLACE) GPA/LU 85-13 - CITY OF CARLSBAD (ALGA HILLS) GPA/LU 86-1 - CITY OF CARLSBAD (OPEN SPACE). WHEREAS, the Planning Commission did on January 8, 1986 and January 22, 1986 hold duly noticed public hearings as prescribed by law to consider amendments to the Land Use Element of the General Plan GPA/LU 85-7, GPA/LU 85-13 and GPA/LU 86-1; and WHEREAS, the Planning Commission has determined that these projects would not have significant impacts on the environment and the City Council has concurred and Negative Declarations were issued and approved in satisfaction of the requirements of the City of Carlsbad Environmental Protection Ordinance of 1980 and the California Environmental Quality Act: and WHEREAS, the City Concil did on February 11 and February 18, 1986 hold duly advertised public hearings to consider said amendments and at that time received the recommendations, objections, protests and comments of all interested persons desiring to be heard; and WHEREAS, the City Council, after considerig all proposed changes to the Land Use Element of the General Plan, directed the City Attorney to return with appropriate documents to allow the City Council to vote on the change individually as 5 1 2 3 4 5 6 7 8 9 10 11 12 18 0 19 20 21 22 23 24 25 26 27 28 a part of one single amendment to the Land Use Element of the General Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: A. That the above recitations are true and correct. B. That the findings of the Planning Commission as set forth in Planning Commission Resolution No. 2518 (GPA/LU 85-13), Resolution No. 2525 (GPA/LU 85-7), and Resolution No. 2535 (GPA/LU 86-1 ) constitute the findings of the City Council. C. That in addition, the City Council makes the following findings: "1. Since January 1985, the City of Carlsbad has been undertaking a comprehensive review of the Land Use Element of its General Plan. As part of that review a Council appointed Citizens Committee prepared a comprehensive report and recommendation to the City Council. That report was subject to public hearings by both the Planning Commission and City Council. Included in the recommendations of the Land Use Committee, were recommendations concerning development on open space and slope areas. 2. On August 6, 1985, the City Council adopted Interim Ordinance No. 9766, imposing certain temporary land use controls on property within the City, consistent with the recommendation of the Citizens Committee which reviewed the Land Use Element. On September 3, 1985, the City Council adopted Interim Ordinance No. 9771 which extended the restrictions of Ordinance No. 9766 until July 20, 1986. On December 10, 1985, the City Council approved in concept several land use proposals not contained in the Citizens Committee report. The Council finds that it is necessary to amend the Land Use Element of the General Plan and appropriate sections of Title 21 of the Carlsbad Municipal Code to implement the Open Space policies previously approved by the Council. 3. This action of the City Council is consistent with long standing policies and objectives of the City to protect significant open space areas within Carlsbad, to enhance the environment of the City by protecting those significant open space areas and to improve the quality of life within the City bp ensuring that a sufficient balance between open space and developed areas continues to exist within the City. This action will protect the public health, safety and welfare of the 2. 1 2 3 4 5 6 7 a 9 20 11 12 18 19 20 21 22 23 24 25 26 27 28 citizens of Carlsbad by preserving significant environmental features and by preserving natural and man made open space buffers between and within urbanized areas of the City. Further, protection of open space areas will ensure both passive and active recreational opportunities for the citizens of Carlsbad. This action will also protect the rights of property owners by cleraly delineating those properties which are not developable, allowing the property owner a better opportunity to assess the development potential of their property. This action will also result in more accurate density calculations since nondevelopable open space areas may not be included in density calculations. 4. This action is consistent with the City's policy to provide housing opportunities for all economic sectors of the community, because sufficient opportunities for new housing continue to exist within the City even though the absolute number of housing units which may ultimately be constructed will be reduced. Reduction of residential densities and protection of open space will ensure the quality of life and the environment within the City of Carlsbad. In addition, development of housing for low and moderate income persons and families would most likely occur in areas of the City already designated for higher density residential development. These areas will be affected by this action only to a limited extent." D. That the Land Use Element of the General Plan be amended as follows: 1. GPA/LU 85-7 LA CORUNA PLACE: To change the Land Use Element from RMH to RM for approximately 1.58 acres of property generally located on the south side of La Costa Avenue, west of La Coruna Place as shown on the map marked Exhibit A - GPA/LU 85-7 attached hereto and made a part hereof. 2. GPA/LU 85-13 ALGA HILLS: To change the Land Use Element from RMH to RM on approximately 64 acres of property generally located on the south side of Alga Road east of Alicante Road as shown on the map marked Exhibit A - GPA/LU 85- 13 attached hereto and made a part hereof. 3. GPA/LU 86-1 CITY OF CARLSBAD: To change the Land Use Element of the General Plan by revising the text to revise the density calculations for open space lands as follows: 3. 7 22 23 24 25 26 27 28 “Residential density shall be determined based on the number of dwelling units per developable acre of property. The following lands are considered to be undevelopable and shall be excluded from density calculations: ( 1 ) beaches (2) permanent bodies of water (3) floodways (4) slopes with an inclination of greater (5) significant wetlands (6) significant riparian woodland habitats (7) Land subject to major power transmission easements (9) land upon which other significant environmental features as determined by the enviornmental review process for a project are located. than 40% No residential development shall occur on the lands listed above, however, the City Council may permit limited development of such property if when considering the property as a whole the prohibition against development would constitute an unconstitutional deprivation of property. Limited development of accessory or nonresidential uses may be permitted.
