HomeMy WebLinkAbout1986-03-18; City Council; Resolution 84421 2 3 4 5 6 7 a 9 1.0 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 8442 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AGRICULTURAL GRADING (PE 2.86.15) PERMIT, SUBJECT TO CONDITIONS. APPLICANT: UKEGAWA BROS., INC. CASE NO.: PE 2.86.15 WHEREAS, on September 3, 1985 the City Council adopted Ordinance No. 8105 establishing requirements for clearing of vegetation; and WHEREAS, on January 29, 1986 Ukegawa Bros., Inc. requested issuance of a grading permit in accordance with Ordinance No. 8105; and WHEREAS, subject to conditions, this operation will cause damage to any environmentally sensitive areas; and WHEREAS, in accordance with Council Policy No. 29 interim land use for agricultural purposes is hereby propos NOW, THEREFORE, BE IT RESOLVED by the City Council of City of Carlsbad, California, as follows: A. That the above recitations are true and correct. not the d; the 6. That, subject to the fulfillment of the following conditions, the agricultural grading permit is hereby approved. 1. Prior to issuance of this agricultural grading permit, the applicant shall submit to and receive approval of a biological and archeological study of the proposed area to be farmed. 2. This permit is subject to the express condition that dust control, overspraying of fertilizers/ pesticides, and noise shall be kept to acceptable levels, to be monitored by the public works inspector. Prior to issuance of this agricultural grading permit the applicant shall receive approval of an erosion control plan by the City Engineer. Prior to issuance of this agricultural grading permit, the applicant shall submit a soils survey to justify the farming activity on this site. The soils survey shall be reviewed and accepted by the City Engineer. Prior to the issuance of this agricultural grading permit, the applicant shall clean up the silt choked stream of the Encinas Creek. Silt from recent farming activity shall be removed from the creek bed, and the drainage path shall be restored to an acceptable alignment and grade (close to natural) as determined by the City Engineer and the Planning Director. (The removed silt shall be placed in a non-erosive manner.) This permit is subject to the express condition that the applicant shall restore and revegetate the site when the activity is discontinued. A bond for this reseeding shall be posted with the City Engineer prior to issuance of this grading permit.
