RESOLUTION NO. 8468
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA DENYING THE MITIGATED
NEGATIVE DECLARATION ISSUED BY THE PLANNING
DIRECTOR AND DIRECTING THE PREPARATION OF AN
ENVIRONMENTAL IMPACT REPORT FOR A 216 UNIT
TENTATIVE MAP AND CONDOMINIUM PERMIT
CT 85-23/CP-320 - r WHEREAS, on March 18, 1986 the City Council held a
public hearing to consider a request to approve a 216 unit
tentative map and condominium permit, CT 85-23/CP-320 and to
consider approving the mitigated negative declaration for the
project issued by the Planning Director; and
WHEREAS, at the public hearing it became apparent that
there is a serious public controversy over the environmental
effects of the project; and
WHEREAS, members of the public challenged the
conclusions of the environmental impact assessment and of the
studies and reports submitted by the project applicant
particularly with respect to the environmental impacts that the
project may have on: (a) traffic circulation in the vicinity
whether arising directly from the project or in combination with
other reasonably foreseeable projects within the immediately
surrounding vicinity; (b) the biological habitat as a result of
the destruction of a large number of mature trees which may
constitute the habitat for a variety of bird species; (c) the
Buena Vista Lagoon as a result of siltation from the project and
slope stability within the project; (d) the social and economic
environment as it relates to the physical :change occuring from
the elimination of a historic eucalyptus grove and replacing tha
grove with multifamily dwelling units; (e) the elimination of

natural recreational activities provided by the grove; and
WHEREAS. the Council finds based on the testimony and
documentary evidence presented that substantial evidence has beer
presented that the project may have a significant effect on the
environment. The Council further finds that because it is not
clear that the significant effects have been reduced to a level
of nonsignificance by the mitigation measures proposed for the
project or by the redesign of the project, that further study in
the form of an environmental review for the project is required;
and
WHEREAS, preparation of the environmental review will
provide the Council with the information it needs to fully assess
the project and will allow the Council to consider alternatives
to the project, the preparation of an environmental impact report
will provide the citizens of Carlsbad with an opportunity to be
fully apprised of all environmental effects which may results
from the project; and
WHEREAS, full and careful consideration of the 18

environmental impacts of a project is required by both state and
local law,
NOW, THEREFORE, the City Council of the City of Carlsbac
resolves as follows:
1. That the above recitations are true and correct.
2. That the conditioned negative declaration prepared
for CT 85-23/CP-320 is hereby disapproved.
3. That an environmental impact report shall be
prepared for the project referred to as CT 85-23/CP-320.

4. That the environmental -impact report shall include
consideration of project alternatives including but not limited
to a no project alternative, a residential density reduction
alternative and a reduction in scale alternative.
5. That further consideration of CT 85-23/CP-320 is
continued until after the completion of the environmental impact
report.
6. That the Planning Director is instructed to prepare
and process all general plan and zone code amendments necessary
to implement each alternative identified in the environmental
impact reports so that the amendments may be considered at the
same time as CT 85-23/CP-320 is reconsidered.
PASSED, APPROVED AND ADOPTED at a regular meeting of
the City Council of the City of Carlsbad, California held on the
1st day of April , 1986 by the following vote to wit:
