8665 RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, SUMMARILY
VACATING AN EASEMENT FOR STREET PURPOSES OVER A PORTION OF AVENIDA ENCINAS.
WHEREAS, the above street right-of-way previously dedicated will provide
no useable access to the adjoining properties after the realignment of
Windrose Circle.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the dedication occurred less than five years but mre than one
year ago, and the easement was not used continuously since.
3. That, pursuant to Section 8333(b) of Chapter 1050 of the California
Street Highway's Code, the easement for street purposes dedicated to the
public over Avenida Encinas and as shown on Parcel Map 13653, be summarily
and
vacated.
4.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
Council held on the 8thday of July , 1986 by the following vote, to
wit:
The City Clerk is instructed to record this Resolution of Vacation.
AYES: Council Members Casler, Lewis, Kulchin, Chick and Pettine
NOES: None
ABSENT: None
