HomeMy WebLinkAbout1986-07-15; City Council; Resolution 86761 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 8676 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AN AGREEMENT BETWEEN THE CITY OF CARLSBAD AND THE CARLSBAD BOYS AND GIRLS CLUB TO PROVIDE LITTER REMOVAL SERVICES AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT The City Council of the City of Carlsbad, California, does hereby resolve as follows: 1. That certain agreement between the City of Carlsbad and the Carlsbad Boys and Girls Club to provide litter removal services, a copy of which is attached hereto marked Exhibit "A" and is on file in the City Clerk's office, is hereby approved. 2. That the Mayor of the City of Carlsbad is hereby authorized and directed to execute said extension for and on behalf of the City of Carlsbad. RAUTENKRANZ, City (SEAL) .- e AGREEMENT FOR PROVIDING LITTER REMOVAL SERVICES THIS AGREEMENT entered into this LL'' - day of Tu2 , 1986, by and between the City of Carlsbad, a municipal corporation of the State of California, hereinafter referred to as "Carlsbad", and the Carlsbad Boys and Girls Club, hereinafter referred to as "Club". WITNESSETH: WHEREAS, Carlsbad is engaged in various street maintenance programs including street sweeping to pranote the safety, health ad general welfare of its citizens; and WHEREAS, it is deemed appropriate to accunplish litter removal from the r City rights-of-way by agreement with the Club; and WHEREAS, the Club can provide litter removal service for just compensation and in the public interest; NOW, THEREFORE, IT IS AGREED as follows: (1) DUTIES OF CARLSRAD A. Provide appropriate warning signing, equipment and disposal of collected litter. B. Provide appropriate inspection of the cleared areas. C. Reimburse the Club on a monthly basis in the amount of $400.00 on the codition of faithful performance of litter removal. (2) DUTIES OF THE CLUB A. Provide a minimum of seven (7) and maximum of ten (IO) youth members to work, ages 12 to 16 years. B. Provide adult supervision on the basis of one (1) adult per ten (IO) youth members. C. Provide vehicle and transport youth members and supervisor to/fran work sites . 0. Conduct litter removal during the period 7:30 a.m. to 1:30 p.m. on Saturday. Specific Saturday to be scheduled to the mutual satisfaction of the Club and City. (See Attachment "A", 1985-86 Schedule.) E. Take all necessary measures to ensure the safety of personnel involved in the litter removal efforts. Provide litter removal fran the rights-of-way on the following locations and others, as determined by the F. City: 1. Palmar Airport Road - fran El Camino Real east to the City Limits (Linda Vista Lane). Alga Road - Alicante to El Fuerte, including the median. Coast Highway (Carlsbad Boulevard) frcm Palomar Airport Road to the Batiquitos Bridge, including the median. El Camino Real - Kelly Drive to Marron Road, including the median 2. 3. 4. fran Chestnut to Marron. 5. El Camino Real - south fran Beckman entrance to end of industrial area. 6. Cannon Road - Carlsbad Boulevard to east end. 7. Marron Road - El Cmino Real to Avenida de Anita. 8. Chestnut - Monroe to El Camino Real. 9. Poinsettia Lane - Avenida Encinas to Batiquitos Lane. (3) PAYMENT Payment to the Club on the basis of one canplete litter clean-up per month in the amount of $400.00 per month during the period of this agreement. -2 - (4) TERM - This Agreement will be effective upon date of execution of this agreement by the Mayor of Carlsbad. It shall terminate on 3une 30, 1987. During said term, this agreement may be terminated at any time upon thirty (30) days written not ice. (5) INSURANCE The Club shall provide City a certificate of insurance naning the City as additionally insured on their normal liability policy. ( 6 ) HOLD HARMLESS AGREEMENT Carlsbad, its officers and employees shall not be li&le for any claims, liabilities, penalties or fines or any damage to goods, properties, or effects I of any person hatever, or personal iduries to or death of them caused by, or. resulting fran, or claimed to have been caused by, or resulting fran, any act or omission of Carlsbad, its officers or employees. The Club further agrees to indemnify and save free and harmless Carlsbad and its authorized officers and employees, against any of the foregoing liabilities and claims thereof, and any cost and expense that is incurred by the City on account of any claim thereof. (7) NOTICES All notices required herein shall be in writing and delivered in person or sent by mail. Notice to Carlsbad shall be addressed: City Manager, 1200 Elm Avenue, Carlsbad, California, 92008. Notices to the- Club shall be addressed: Executive Director, P.O. Box 913, Carlsbad, California, 92008. -3- “I ..
