WHEREAS, the City Council of the City of Carlsbad, has required
developer of Carlsbad Tract No. 81-19, Unit No. 1, to obtain the dedication
and make certain improvements for the road known as Oannis Way; and
WHEREAS, the City of Carlsbad is the fee title owner of the property
underlying a portion of the proposed road to be dedicated; and
WHEREAS, the City of Carlsbad is not in a position to dedicate property
to itself;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the City of Carlsbad, California, designates and reserves that
portion of the Ellery Reservoir property, described on attached Exhibit 'A'
for public road and utility purposes. The reserved property is shown for
convenience on Exhibit 'B1 which is attached hereto and made a part hereof.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
Council held on the 15th day of July , 1986 by the following vote, to
wit:
AYES: Council Members Casler, Lewis, Kulchin, Chick and Pettine
NOES: None
ABSENT: None
