RESOLUTION NO. 8836
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA SUMMARILY VACATING AN
EASEMENT OVER BLUE WHALE COURT.
WHEREAS, the above street right-of-way previously dedicated and shown on
attached Exhibit 'B', will provide no useable access to the adjoining
properties after the recordation of Adjustment Plat No. 317; and
WHEREAS, Kaiser Development company has submitted a quitclaim of access
rights to Loker Avenue;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That said portion of the street has not been used for the past five
years.
3. That, pursuant to Section 8330 of Chapter 1050 of the California
Street and Highway's Code, said easement references above, be summarily
vacated.
4. The City Clerk is instructed to record this Resolution of Vacation.
5. That the Quitclaim Deed conveying access rights to Loker Avenue of
Carlsbad Tract No. 74-21, to the City of Carlsbad, which is on file with the
City Clerk and is incorporated by this reference; is approved.

6. That the City Clerk is hereby authorized to cause the original
Quitclaim Deed to be recorded in the Office of the County Recorder of San
Diego County, State of California.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad
City Council, held on the 7th day of October, 1986, by the following vote,
to wit:
