RESOLUTION NO. 8916
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, SUMMARILY VACATING
AN EASEMENT OVER A PORTION OF AFTON WAY.
WHEREAS, the City of Carlsbad has approved a boundary adjustment between
the Jandro Property and the Multitech property; and
WHEREAS, the boundary adjustment creates a condition whereby a portion of
Afton Way serves no useful benefit to the public ot to the adjacent property
owners; and
WHEREAS, the adjacent property owner has requested vacation of the portion
of Afton Way more fully described on Exhibit "A" of this Resolution.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That said portion of Afton Way, more particularly described on Exhibit
"A" attached hereto, is excess right-of-way of a street not required for street
purposes; and
3. That portion of Afton Way lies entirely within property under one
ownership and that does not continue through such ownership or end touching
property of another; and
4. That portion of Afton Way has not been used for a period of five
consecutive years and no public money has been expended for its maintenance
during that period; and

5. That pursuant to Section 8334 of Article 1 of Chapter 4 of Part 3 of
ivision 9 of the California Streets and Highways Code, said portion of Afton
ay be summarily vacated.
6. The City Clerk is instructed to record this Resolution of Vacation.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
ouncil held on the 22nd day of December , 1986 by the following vote, to

OF CALIFORNIA AS DEDICATED ON MAP 11578 RECORDED JULY 19, 1986 IN THE OFFICE OF
THE COUNTY RECORDER OF SAID COUNTY, LYING WESTERLY OF THE FOLLOWING DESCRIBED
LINE :
BEGINNING AT A POINT IN THE SOUTHERLY LINE OF LOT 2 OF SAID MAP 11578 SAID
POINT BEING 'SOUTH 70'19' 19'' EAST 26.29 FEET EASTERLY FROM THE WESTERLY TERMINUS
