HomeMy WebLinkAbout1987-01-06; City Council; Resolution 89351 4 E % c E 11 t 1-5 19 20 21 22 23 24 25 26 27 28 0 RESOLUTION NO. 8935 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF OF THE GENERAL PLAN TO BRING THE DESIGNATIONS ON THE GENERAL PLAN MAP, ZONING MAP, AND LOCAL COASTAL PLAN MAP IN CONFORMANCE ON PROPERTY LOCATED IN THE CITY OF CARLSBAD. APPLICANT: CITY OF CARLSBAD CASE NO: GPA/LU 86-8 CARLSBAD, CALIFORNIA, AMENDING THE LAND USE ELEMENT WHEREAS, the Planning Commission did on July 30, 1986, August 13, 1986, and August 27, 1986 hold duly noticed public hearings as prescribed by law to consider amendments to the Land Use Element of the General Plan GPA/LU 86-8; and WHEREAS, THE RECOMMENDED General Plan Amendments within the Coastal Zone to bring General Plan designations into conformance with the Carlsbad Local Coastal Plan are exempt from environmental review per Section 15265(a)(l), Title 14 of the California Administrative Code; and WHEREAS, the Planning Commission has determined that this project outside of the Coastal Zone will not have a significant impact on the environment and the City Council has concurred and a Negative Declaration was issued and approved in satisfaction of the requirements of the City of Carlsbad Environmental Protection Ordinance of 1980 and the California Environmental Quality Act; and WHEREAS, the City Council did on December 22, 1986 hold a duly advertised public hearing to consider said amendments and at that time received the recommendations, objections, protests and comments of all interested persons desiring to be heard; and WHEREAS, the City Council, after considering all proposed changes to the Land Use Element of the General Plan, directed the City Attorney to return with appropriate documents to allow the City Council to vote on the change individually as i part of one single amendment to the Land Use Element of the General Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: A, That the above recitations are true and correct. B. That the findings of the Planning Commission as set forth in Planning Commission Resolution No. 2584 (GPA/LU 86-8), attached hereto and made a part hereof constitute the findings of the City Council with the exception that all references to Exhibit "N-1" be deleted. C. That the Land Use Element of the General Plan be amended as follows: 1. GPA/LU 86-8 CITY OF CARLSBAD: To make a series of changes in the Land Use Element of the General Plan as shown on Exhibits IlAIl IIBlI *@F18 llHl8, (8 J", rlLl8, I1M" , I1 PI1 , IIQSI , NSII , IIXII , and "MM" dated July 14, 1986 attached hereto and 18 zw , 11 EEII , 81 FF88 made a part hereof. APPLICANT: CITY OF CARLSBAD CASE NO.: GPA/LU 86-8 WHEREAS, a verified application for an amendment to the General Plan designation for certain property located, as shown on Exhibits "A81, "Bit, "FIl, 11HI!, IfJtI, "Lt1, IlMI~, f1pll "Q", !lSll, 1!Xtt, !!Ztl , 11~~11, 11~~11 , dated, July 14, 1986, and Exhibits 'IN-l", and "MM" date August 5, 1986, attached and incorporated herein, has been filed with the Planning Commission; and WHEREAS, said verified application constitutes a request for amendment as provided in Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 30th day of July, 1986, hold a duly noticed public hearing as prescribed by law to consider the proposed Generai Plan Amendments shown on Exhibits br I'FF'', 81AI1, !lgll, ItHIl, IILII 11~11, llpll, Ilqtl, llsll, llxll, llzll, IIEEII, ¶ dated July 14, 1986; and WHEREAS, the Planning Commission did on the 13th day of August, 1986 hold a duly noticed public hearing as prescribed by la to consider the proposed General Plan Amendments as shown on Exhibits "F", "J", "EE", dated July 14, 1986, and Exhibit "N-1" dated August 5, 1986; and WHEREAS, the Planning Commission did on the 13th and 27th day of August, 1986 hold a duly noticed public hearing as prescribe by law to consider the proposed General Plan Amendment .. .. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 as shown on Exhibit "MM" dated August 5, 1984; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the General Plan Amendment, NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad, as follows: A) That the above recitation are true and correct. B) That based on the evidence presented at the public hearing, ti Commission recommends APPROVAL of GPA/LU 86-8 as shown on llzll , "EE", "FF", dated July 14, i986 and Exhibits "-1" and "MM" dated August 5, 1986, attached hereto and made a part hereof based on the following findings: Exhibits "Al8, !1Bll, flF18, IIHII, IIJtl "LlI, "11, 1$11 , Ilqll, llsll, 11x1 Find ines : The proposed General Plan Amendments will bring the designations on the General Plan Map, Zoning Map and Local Coastal Plan Map into conformancy as required by State law. The recommended General Plan designations are appropriate for the properties involved because the General Plan Amendments will allow for development on the sites that will be compatible with surrounding development for the reasons state< in the staff report. The recommended General Plan Amendments within the Coastal Zone to bring General Plan designations into conformance with the Carlsbad Local Coastal Plan are exempt from environmental review per Section 15265A1 of the California Environmental Quality Act. The Planning Director has determined that the recommended General Plan Amendments outside of the Coastal Zone will not cause any signifkcant envXr6nuental impacts and issued NegatiT Declarations on July 12, 1986 which were recommended for approval by the Planning Commission on August 13, 1986.
