RESOLUTION NO. 8936
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING THE CARLSBAD LOCAL
COASTAL PLAN
APPLICANT: CITY OF CARLSBAD
CASE NO.: LCPA 86-1
WHEREAS, the Planning Commission did on July 30, 1986,
August 13, 1986 and August 27, 1986 hold duly noticed public
hearings as prescribed by law to consider an amendment to the
Local Coastal Plan LCPA 86-1; and
WHEREAS, the recommended Local Coastal Plan Amendments
to bring Local Coastal Plan designations into conformance with
the Carlsbad General Plan are exempt from environmental review
per Section 15265(a)(l) Title 14, of the California
Administrative Code; and
WHEREAS, the City Council did on December 22, 1986 held
a duly advertised public hearing to consider said amendments and
at that time received the recommendations, objections, protests
and comments of all interested persons desiring to be heard; and
WHEREAS, the City Council, after considering all
proposed changes to the Local Coastal Plan, directed the City
Attorney to return with appropriate documents to allow the City
Council to vote on the change individually as a part of one
single amendment to the Local Coastal Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Carlsbad, California as follows:
A. That the above recitations are true and correct.
B. That the findings of the Planning Commission as set
forth in Planning Commission Resolution No. 2586 (LCPA 86-l),
attached hereto and made a part hereof, constitute the findings

of the City Council with the exception that all references to
Exhibits "N" and s'N-l" be deleted.
C. That the Local Coastal Plan be amended as follows:
1. LCPA 86-2 CITY OF CARLSBAD: To make a series of
changes in the Local Coastal Plan as shown on Exhibits 'IF", "G",
IlItl , 11 JW , IIK~I I rtUl1 , llVt# , "WII , "Y", ''AA" through "EE", IIMM" and
"NN" dated July 14, 1986 attached hereto and made a part hereof.
D. That Council directed the Planning staff to forward
a copy of this resolution to the California Coastal Commission
for its cons ideration.
PASSED, APPROVED AND ADOPTED at a regular meeting of thc
City Council of the City of Carlsbad, California, held on the
6th day of January I 1987 by the following vote, tc

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CAKLSBAD, CALIFORNIA, REXOMMENDLNG APPROVAL OF AN
AMENDMENT TO THE CARLSBAD LOCAL COASTAL PLAN TO BRING THE DESIGNATIONS ON THE LOCAL COASTAL PROGRAM, GENERAL PLAN
THE CITY OF CARLSBAD. APPLICANT: CITY OF CARLSBAD

MAP AND ZONING MAP INTO CONFORMANCE ON PROPERTY LOCATED Ic
WHEKEAS, Calfornia State law requires that the Local
Coastal Plan, General Plan and Zoning designations for properties
in the Coastal Zone be in conformance;
WHEREAS, a verified application for an amendment to the
Local Coastal Plan designations for certain property located, as
shown on Exhibits "F" , "GI' , "I" , llJ" , IIKIl, f1U11, !lVl1 , !!Wlf, "y!!,
EE", dated July 14, 1986, and Exhibits "N", "N-1" and "MM" I 'MI I - I I
dated August 5, 1986, attached and incorporated herein, has been
filed with the Planning Commission; and
WHEREAS, said verified application constitutes a request
for amendment as provided in Title 21 of the Carlsbad Municipal
Code; and
WHEREAS, the Planning Commission did on the 30th day of
July, 1986 hold a duly noticed public hearing as prescribed by law
to consider the proposed Local Coastal Plan Amendments shown on
Exhibit "GI1 , "I", "K" , "W" , "Y" , t'~'l-'lDD'l, dated July 14, 1986

WHEREAS, the Planning Commission did on the 13th and 27th
day of August, 1986, hold a duly noticed public hearing as
prescribed by law to consider the Local Coastal Plan Amendment as
shown on Exhibit "MM" dated August 5, 1986; and
WHEREAS, at said public hearings, upon hearing and
considering all testimony and arguments, if any, of all persons
desiring to be heard, said Commission considered all factors
relating to the Local Coastal Plan Amendment.
WHEREAS, State Coastal Guidelines requires a six week
public review period for any amendment to the Local Coastal

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the,City of Carlsbad, as follows:

That the foregoing recitations are true and correct.
That based on the evidence presented at the ublic hearing,
"EE", dated July 14, 1986, and Exhibits "N", "N-1" and "MM"
dated August 5, 1986, attached hereto and made a part hereof based on the following findings:
At the end of the State mandated six week review period, starting on July 30, 1986 and ending on September 10, 1986, staff shall present to the City Council a summary of the comments received.

Findings :
1) The proposed changes to the designations on the Local Coastal Plan accurately represent existing land use patterns on the subject properties for the reasons stated in the attached staff report.
2) The proposed changes to the designations on the Local Coastal Plan will allow the subject properties to develop in accordance with their existing General Plan designations as detailed in the attached staff report.

3) The recommended Local Coastal Plan Amendments to bring Local Coastal Plan designations into conformance with the Carfsbad General Plan are exempt from environmental review per Section 15265A1 of the California Environmental Quality Act.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Planning Commission of the City of Carlsbad, California, held on
the 27th day of August, 1986, by the following vote, to wit:
AYES : Chairman Schlehuber , Commissioners : Marcus, Schramm and Hall.
NOES : Commissioners: McFadden and Holmes.
ABSENT: Commissioner McBane.
ABSTAIN: None.
