RESOLUTION NO. 9035
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, SUMMARILY VACATING
AN EASEMENT OVER A PORTION OF HARWICH DRIVE.
WHEREAS, the above street right-of-way previously offered for
jedication and shown on attached Exhibit IA', will not provide
improved circulation and access to the adjoining properties if
2onverted to a cul-de-sac street.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
if Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That said portion of Harwich Drive, more particularly
described on Exhibit llA'l attached hereto, is excess right-of-way of
a street not required for street purposes; and
3. That an easement for sewer lines and general utility pur-
3oses over Lot 265 of Map 11588 is excepted from this vacation.
4. That said portion of Harwich Drive has not been used for a
~eriod of five consecutive years and no public money has been
expended for its maintenance during that period; and
5. That pursuant to Sections 8333 and 8334 of Article 1 of
Chapter 4 of Part 3 of Division 9 of the California Streets and
Highways Code, said portion of Harwich Drive be summarily vacated.

5. The City Clerk is instructed to record this Resolution of
Vacation.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Zarlsbad City Council held on the 21st day of April , 1987

AYES: Council Members Lewis, Kulchin, Pettine, Mamaux and Larson

11588, recorded in the office of the County Recorder of said
County described as follows:
Beginning at the Northeasterly Corner of said Lot 212; thence
along the Easterly line of said Lot 212 South 28O53'21" East 27.03 feet to the TRUE POINT OF BEGINNING; thence continuing along the Easterly line of said Lot 211, 210, 209 and 265 South 28'53'21" East 157.97 feet to the beginning of a tangent 270.00 foot radius curve concave Southwesterly: thence Southeasterly
along said curve through a central angle of 00°12'59" an arc distance of 1.02 feet to a point in a non-tangent 50.00 foot radius curve concave Northeasterly, a radial line of said 50.00 foot radius curve to said point bears South 17O20'59" East:
