RESOLUTION NO. 9201
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING A GRANT DEED AND AUTHORIZING PAYMENT
CITY'S IMPROVEMENTS TO PALOMAR AIRPORT ROAD, EAST OF EL
CAMINO REAL. PROJECT NO. 3243
FOR THE PURCHASE OF PRIVATE PROPERTY RIGHT-OF-WAY FOR THE
WHEREAS, the City Council of the City of Carlsbad has
previously appropriated funds in its Capital Improvement
Program budget to construct improvements to Palomar Airport
Road east of El Camino Real; and
WHEREAS, certain private property rights-of-way are
required to facilitate construction of these improvements; and
WHEREAS, negotiations with the private property owner have
resulted in an agreement to purchase the aforementioned right-
of-way; and
WHEREAS, a real property appraisal for said right-of-way
establishing value has been completed by Gerald S, Kibbey, MAI,
and Associates; and
WHEREAS, it is both necessary and in the public interest
to purchase said right-of-way for this project;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:
I 1. That the above recitations are true and correct.
2. That the attached grant deed describing certain right-
of-way, from the property owner, Mary E. Bressi, is hereby
accepted and the City Clerk is authorized and directed to
record said grant deed.
3. That the Finance Director is hereby authorized to
approve a payment in the amount of $49,000 for the purchase Of

said right-of-way representing the fair market and agreed upon
value as established by the appraisal completed by Gerald S.
Kibbey, MAI, and Associates on file in Municipal Projects
I

Department.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 18th day of August 9
1987 by the following vote, to wit:
AYES: Council Members Lewis, Pettine, Mamaux and Larson
NOES: None
ABSENT : Council Member Kulchin
