WHEREAS, the applicant for SDP 84-5 has requested that occupancy be
granted prior to completion of required public impravemnts; and
WHEREAS, the applicant will provide security for the hnproverm~ts in
accordance with Section 20.16.080 of theMunicipal code ; and
WHEREAS, ccunplim- with Condition 34 could result in extreme
hardship for the applicant.
NOW, THEREFDm, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as folllm:
1. That the above recitations are true and correct.
2. That the CbfLkion 34 of City Council Resolution No. 7956 be
revised as follws:
Add the following statement:
At the discretion of the Co" 'ty Development Director
the developer may obtain ocapanq of all buildings except SuitesA, B, C, D, andEofWlildingCandSuitesF, G,H,
and J of mlding G (total approximately 13,000 square feet) prior to completion of the hnprovanents pravided the conditions listed helow are met:
1. The developer shall canplete an erosion control plan for drainage over the areas partially graded along Palmer Way and Cougar Drive. Additional (fiesiltation basin (s) will be

2. The developer shall construct additional detention basjns in accordam=e with Condition 31 of Resolution No. 7956. This condition will not apply if the drainage system is cumpleted.

entrance to El camin0 Real to the satisfaction of the Fire chief and City Engineer. Entrance
is to min closed until palmer Way and Cougar Drive are Canplete and open to traffic and median islarid construction is complete sufficient to restrict left-turn mvements out of the entrance as determined by the City
No further pennits or ocmpanq shall be granted until all imp:ravements have been ccarq?leted to
the satisfaction of the city Engineer including installation of the full median island fm south of Cougar Drive to Faraday Awe.
