RESOLUTION NO. 88-12
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, SUPPORTING THE USE OF MITIGATIOI
FEES ON DEPOSIT WITH THE CALIFORNIA COASTAL CONSERVANt
REQUIRED FOR THE DEVELOPMENT OF NONPRIME AGRICULTURAL
LAND IN THE COASTAL ZONE WITHIN THE CITY OF CARLSBAD FOR THE CONSTRUCTION OF A BEACH ACCESS STAIRWAY AT MA: AVENUE WITHIN THE CITY OF CARLSBAD
WHEREAS, the California Coastal Act of 1976
mitigation fees for development of nonprime agriculturz
in the Coastal Zone within the city of Carlsbad out
specified areas to be deposited with the California
Conservancy; and
WHEREAS, said fees are appropriated from time to
means of special State legislation from the State
Conservancy Fund to the California Coastal Conserva
expenditure for specified purposes; and
WHEREAS, Assembly Bill 1291 (Frazee) became effec
January 1, 1988 amending Section 30171.5 of the Public R
Code relating to coastal resources; and
WHEREAS, amended Section 30171.5 of the Public R
Code provides the opportunity for the city of Carl
request from the California Coastal Conservancy, in cons
with the California Coastal Commission, the use of up
percent (50%) of said appropriated funds to provide as
public beaches in the city of Carlsbad; and
WHEREAS, California Coastal Conservancy st:
identified the amount of one hundred thousand dollars (5
to be available to the City of Carlsbad for this project
WHEREAS, the City Council of the City of Carlsbad,

NOW, THEREFORE, BE IT RESOLVED by the City Council

Conservancy in accordance with the provisions of amended
30171.5 of the Public Resources Code.
PASSED, APPROVED AND ADOPTED at a regular meeting
