- RESOLUTION NO. 88-58
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, CALLING, ORDERING, PROVIDING FOR AND GIVING NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, THE 7TH DAY OF JUNE, 1988, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY AN ORDINANCE RELATING TO INCREASE THE TRANSIENT OCCUPANCY TAX RATE FROM 6% TO 8%.

7 WHEREAS, the City Council of the City of Carl sbad desires to SI

SECTION 1. That the above recitations are true and correct. 14

AN ORDINANCE OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 3, CHAPTER 3.12 OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTIONS
3.12.030 TO INCREASE THE TRANSIENT OCCUPANCY TAX RATE TO 8"h.
The People of the City of Carl sbad do ordain as foll ows:
SECTION 1: That Title 3, Chapter 3.12 of the Carlsbad Munici

amended by the amendment of Section 3.12.030 to read as follows:

"3.12.030 ImDosition--Amount--Where Dayable. For tl, privilege of occupancy in any hotel, each transient i subject to and shall pay a tax in the amount of eigh percent of the rent charged by the operator. Such ta constitutes a debt owed by the transient to the City whic is extinguished only by payment to the operator or to th City. The transient shall pay the tax to the operator c the hotel at the time the rent is paid. If the rent is pai in installments, a proportionate share of the tax shall b paid with each installment. The unpaid tax shall be du upon the transient's ceasing to occupy space in the hotel If for any reason the tax due is not paid to the operator o the hotel, the tax administrator may require that such ta shall be paid directly to the tax administrator."
