For the purpose of this agreement, t Chief of the Carl sbad Fire Department or his designee shall serve as te advisor to the Purchasing Officer, and shall assist and advise on all te matters pertaining to the materials? design, engineering principles equipment specified herein. 1.012 The word "Contractor" shall mean "Beck Fire Apparatus" and its aut representatives. 1.02 PRE-CONSTRUCTION CONFERENCE The purchaser and contractor will participate in a pre-construction con to review and discuss the construction details after receipt of the order contractor but before construction commences. All plans and specifications must be approved by the Department prior t of contract. Two (2) Operators Manuals. 1.07 WARRANTIES At the time of delivery, the Contractor shall deliver to the City one I of each of the certificates or forms properly completed and cover apparatus delivered: A. Chassis manufacturer's certified warranty. B. Accessory item information and warranties. C. Beck apparatus warranties. Name of Apparatus By : Authorized Signature 1.08 DELIVERY Delivery shall be on the 2nd inspection trip, in Cloverdale, CA. Any c del ivery shall be included in the cost of the apparatus. A competent delivery engineer shall arrive in Carlsbad two weeks after of the apparatus and shall instruct the Fire Department personnel in th operation and maintenance of the apparatus. The delivery engineer shal in the area for the period of time deemed necessary by the Fire Ch unless unusual circumstances prevai 1 , not to exceed two (2) days. The engineer shall be a full time employee of that company manufactur apparatus. The City is to provide a letter of self-insurance bet Contractor delivers the apparatus. 1.09 TESTING AND SPECIAL PROVISIONS In addition to complying with the aforementioned detailed specificatic apparatus, as delivered shall comply with the following applicable pri listed in the latest edition of the National Fire Protection Asso Pamphlet 1901. "Provisions applying to apparatus equipped with a fire pump." "Provisions applying to apparatus equipped with a hose body." "Provisions applying to apparatus equipped with a water tank." "Acceptance tests and requirements. I' In all cases the detailed fire apparatus specifications, and detail apparatus chassis specifications, shall govern construction. The apparatus shall conform to a1 1 rules and the regulations of t Department of Transportation and the State of California Motor Vehicle Cc 1.10 DELIVERY SCHEDULE After receipt of purchase order, the agreed upon delivery date is establ. 0 - 90 calendar days 'after Beck Fire Apparatus receives the truck chassi! *.I-= a. : 0 1.11 FINAL ACCEPTANCE Final acceptance will be recognized as payment in full from the City. TI will retain ten percent (10%) of the total purchase price until final accl is authorized by the Carl sbad Fire Department representative. The together with its authorized representative, will be the sole judge oi acceptance. 1.12 PAYMENT SCHEDULE AND TERMS The City agrees to purchase from the Contractor a 1,000 G.P.M. Class "A" Beck Model FV-122TSB on a Ford C-8000 cab and chassis designed and built specifications contained in proposal dated April 11, 1988. The full p price for the 1,000 G.P.M. Class "A" Pumper, Beck Model FV-122TSB on a 8000 cab and chassis is $133,066.00. Payments shall be made based upon the following schedule: A. At delivery of the complete vehicle, after preliminary acc test: 90% of balance due. B. Accompanying written notification of final acceptance of vehi later than two (2) weeks after delivery, the remaining 10% due. C.
