HomeMy WebLinkAbout1988-07-05; City Council; Resolution 88-2191 ’r“ f h. 1 2 3 4 5 6 7 8 9 IO 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 e e RESOLUTION NO. 88-219 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AND PROVIDING FOR CONTRIBUTION TO PAY CERTAIN COSTS AND EXPENSES IN A SPECIAL ASSESSMENT DISTRICT AND APPROPRIATING FUNDS. WHEREAS, the CITY COUNCIL of the CITY OF CARLSBAD CALIFORNI Resolution, declared its intention to authorize the construction of cel of improvement pursuant to the terms and provisions of the “Municipal 1 Act of 1913”, being Division 12 of the Streets and Highway Code of tt California, in a special assessment district known and designated as DISTRICT NO. 86-1 (PALOMAR AIRPORT ROAD) (hereinafter referred ”Assessment District”); and, WHEREAS, the legislative body is desirous at this time of p contribution to pay a portion of the costs and expenses of the proceedings; and, WHEREAS, pursuant to the provisions of Section 10205 of the S Highways Code of the State of California, a contribution may be provi a portion of the costs and expenses at any time prior to the confi rmat proceedings on said Assessment District. WHEREAS, the City will require the appropriation of $120,000 in funds to support the City’s contribution to the District. NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: SECTION 1. That the above recitals are all true and correct. SECTION 2. That the appropriation of the monies as set fc contribution in the Engineer‘s “Report” as herein presented relating tc referenced Assessment District is hereby approved and authorize contribution shall be used to pay for the items of work as set for. Engineer’s ”Report” and the appropriation shall be from the funds as therein. 46 & 1 r 1 46 & 1 r 1 * 0 ' SECTION 3. That said contribution is authorized pursuant to Sec 2 /j of the "Municipal Improvement Act of 1913", being Division 12 of the 1 3 1) Highways Code of the State of Cal ifornia. 4 5 6 SECTION 4.
