RESOLUTION NO. 88-250
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AWARDING THE CONTRACT FOR THE CONSTRUCTION OF CERTAIN PUBLIC WORKS

WHEREAS, the CITY COUNCIL of the CITY OF CAF
CALIFORNIA, did publicly open, examine and declare all
proposals or bids for doing the work and improvements des
in its Resolution of Intention, which Resolution and a "I?
subsequently approved, are hereby expressly referred to
description of said work and improvements and fo
particulars relative to the proceedings for the WOI
improvement, in a special assessment district know
designated as ASSESSMENT DISTRICT NO. 86-1 (PALOMAR P
ROAD) (hereinafter referred to as the "Assessment District
NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
SECTION 1. That the above recitals are all tri
correct.
SECTION 2. That this legislative body hereby rejec
of said proposals or bids except that herein mentioned, ar
hereby award the construction contract for doing said wc
making improvements in the Assessment District to the
responsible bidder, to-wit:

at the prices named in the bid of said bidder on file wi
transcript of these proceedings and open for public inspec
SECTION 3. That this award of contract is
conditioned upon and made subject to the receipt of moni

shall not commence construction or order equipment until :
received a Notice to Proceed. Any progress payment t
Contractor for work completed may be delayed if monies ha
been received from the sale of bonds.
SECTION 4. That the works of improvement sha
constructed in the manner and form as set forth in the pla
specifications for these proceedings, as previously appro
a part of the ltReporttt, as required by law and specifical:
"Municipal Improvement Act of 1913Ig, being Division 12 c
Streets and Highways Code of the State of California.
SECTION 5. That the Mayor and City Clerk are I
authorized to execute the Agreement for the works of improl
relating to said Assessment District, and a copy of
Agreement shall be on file with the transcript of
proceedings.

SECTION 6. That all monies to pay for the costs
expenses of the above referenced Assessment District shal
paid from the funds as deposited in the Improvement E
including any interest earned thereon.
PASSED, APPROVED AND ADOPTED by the City Council of
City of Carlsbad at its regular meeting held on the 19th
of July , 1988, by the following vote, to wit:
AYES: Council Members Lewis, Kulchin, Pettine, and Mamaux
