RESOLUTION NO. 88-290
A RFSOLUTION OF THE CITY COUNCIL OF THE CITY (
CARLSBAD, CALIFORNIA ACCEPTING A GRANT DEED F(
EASEMENT PURPOSES.
WHEREAS, SAMMIS Properties, Inc. has submitted
Deed conveying an easement to the City of Carlsbad
purposes of establishing a 45' setback in Phase I
Batiquitos Lagoon Educational Park Master Plan alc
Batiquitos Lagoon: and
WHEREAS, the City Council of the City of Carls
determined it to be in the public interest to accept sa
NOW, THEREFORE, BE IT RESOLVED by the City Counci
City of Carlsbad, California as follows:
1) That the above citations are true and correct
2) That the Grant Deed from Batiquitos B
California limited partnership acting on behalf of thc
Properties, Inc. and executed by Donald F. Sammis ar
July 25, 1988, conveying an easement for open space :
over a portion of property located along the north shor,
Batiquitos Lagoon and within the first phase of thc
Master Plan to the City of Carlsbad and which is on f
the City Clerk and is incorporated herein by refere
accepted.
3) That the City Clerk is authorized to ce
original deed to be recorded in the office of thc
Recorder of the San Diego County, State of California
appropriate Certificate of Acceptance attached.
