Site and Facilitv Description This permit is for a large volume solid waste transferring anc processing facility known as the Coast Waste Management Trans Station located at 5960 El Camino Real Carlsbad, California wk is referred to in this permit as the tlFacilitytt. The Calif01 Waste Management Board (CWMB) Identification Number for Facility is 37-"001. The Facility was formerly operated by County of San Diego as a transfer and processing station know] the Palomar Solid Waste Transfer Station (CWMB I.D. Number 37- 101). The terms "Applicanttt and ItOperatortt refer to Coast Wz Management, Inc. When issued, this non-transferable permit will allow the Operz to operate the Facility. The permit will be reviewed and rev: at the discretion of the Utilities and Maintenance Department, ( of Carlsbad, which is responsible for the enforcement of non-he; related requirements and. the County of San Diego Department Health Services, Division of Environmental Health Services wl is responsible for the enforcement of health related requireme: The Facility is located on 5.6 acres of a 203 acre parcel ownel the County of San Diego approximately 1600 feet Northeast from intersection of El Camino Real and Palomar Airport Road within incorporated limits of the City of Carlsbad. The Facility consists of three buildings containing 39,840 sq feet including Administrative office space, locker rooms, veh maintenance and sanitary facilities. The transfer and proces area is located in the northeast corner of the building. 1 0 0 tipping deck is concrete and completely enclosed by metal wa with closable doors. Access roads, parking areas, and semi areas are paved with asphalt. A Public Buy-Back Recycling Cen is located on the west side and will allow citizens to sell-th recyclables. The Facility will receive nonhazardous municipal solid waste f homes and businesses which will include: 1. Food and food preparation waste. 2. Paper and paper products. 3. Green materials and trash from yard clean-up. 4. Glass and bottles. 5. Metals. 6. Home appliances and furniture. 7. Small dead animals. 8. Any other non-hazardous solid waste as determined writing by the City of Carlsbad or the County of Diego. Waste will be received from 6:30am to 6:00pm, Monday thrc Saturday. The Facility will be closed every Sunday and on Years Day, Thanksgiving Day and Christmas Day. All unloading 1 be done inside the building. Scavenging will not be all01 however, the Operator will conduct a salvaging operation. Salvage operations will consist of the manual separation of g: bottles, cardboard, ferrous metals, aluminum, other metals, pi products and other materials of economic value. After separal the recyclables will be stored on site in an appropriate manne: mitigate nuisances pending removal. Residual solid waste which is not suitable for recycling wil: loaded into an enclosed trailer with an appropriate cover desi to contain blowing litter and then transported to an appr disposal site for final deposition. 2 e a If hazardous waste is accidentally received, the Operator w notify the City of Carlsbad and the County of San Diego and is01 and segregate the hazardous waste in a prudent manner and contr with a licensed hazardous waste hauler for removal to an appro disposal site. The Facility's design capacity is 400 tons of solid waste operating day. If the Facility experiences problems and is una to process and transfer the waste, the Operator will notify City of Carlsbad and the County of San Diego and cease recei\ waste and direct all refuse hauling vehicles to an apprc disposal site. The Facility is served by the City of Carlsbad sanitary sewel system which will dispose of all waste water. Potable water is provided by the Costa Real Municipal Wz District. No water is used to process the waste. The Facility an automatic sprinkler system which is alarm activated to Carlsbad Fire Department. Additionally, three fire hydrants located outside the building and three fire hoses are within Facility. The nearest residence is approximately 0.3 miles northwest of Facility. The closest non-residential structure, a municipalwi district office, is approximately 1,000 feet to the southwest B. Conformance Findinas 1. The site is zoned Industrial (M-Q) and is conformance with the Approved Conditional Use Pe' (CUP-260) and the General Plan (PI) of the Cit: Carlsbad (letter from City of Carlsbad d 12/03/87). 3 0 0 2. Land uses within 1,000 feet of the site include c space, heavy commercial, and government faciliti 3. This permit is consistent with the San Diego Cou Regional Solid Waste Management Plan as stated the letter of November 2, 1987 from the County San Diego Department of Public Works to Coast W2 Management, Inc. 4. The proposed operation of this facility consistent with the State Minimum Standards Solid Waste Handling and Disposal. C. Sumortina Documents The following documents and/or permits condition the design operation of this facility and are hereby made a part of t permit. 1. The Report of Station Information for a Large Vol Transfer Station, revised March 1988, and attachments submitted by Coast Waste Managem6 Inc., which are on file at the City of Carls Utilities & Maintenance Department Administral office. 2. Conditional Use Permit (CUP-260) approved by Planning Commission of the City of Carlsl California on December 12, 1984, which is on : at the City of Carlsbad Planning Department. 11. Conditions A. Reauirements 1. There are no proposed significant changes in de: or operation of the Facility for five (5) ye; Any significant change in design or operation SI require a revised permit. 2. The design and operation of this Facility SI comply with all State Minimum Standards for SI Waste Handling and Disposal. 4 a e 3. The design and operation of this Facility sh comply with all Federal, State, and IC requirements and enactments. 4. The Operator shall furnish additional informat concerning the design and operation of the Facil when requested by the City of Carlsbad which hereinafter referred to as the Local Enforcen Agency (LEA) . 5. The Facility shall comply at all time with conditions and requirements of the City of Carls Conditional Use Permit (CUP-260). Violations of conditions of the Conditional Use Permit considered violations of this permit and mal grounds for its revocation. Additionally, Facility shall discontinue any portion of operation which is in violation of the condit: of this permit or is determined by the LEA endanger public health, threaten the environmen be unsafe. 6. Ninety (90) days prior to any planned shut dowl operations, the Operator shall notify the LEI writing. 7. The Operator shall establish a program to sc incoming waste and to reject all prohibited wa The program shall be submitted to the LEA, County of San Diego Department of Health Sew Division of Environmental Health Services and California Waste Management Board within sixty days of receipt of approved permit. 8. The Operator shall provide a telephone and work in the Facility's Administration Building to be by the LEA during inspections or surveys at Facility. 5 a a 9. The Operator shall provide the LEA with a lis1 personnel responsible for operations at Facility. This list shall include 24-hour emergi contact information. 10. The term of the permit shall be for five (5) yl from date of permit approval or the term of permittee's lease of the premises, whichever is lesser period of time. The LEA may extend permit for one (1) additional five (5) year pe at the sole discretion of the LEA. Either party the right to terminate the permit on each five year anniversary date of the Permit, upon sixty days written notice to the other party prece that date, unless terminated earlier by the LE provided for in this permit. The conditions procedures for permit revocation by the LEA contained in the California Government C Section 66796.55 et seq and in the Califo Administrative Code, Title 14, Section 18307. 11. Indemnity. The Operator shall assume the def of, pay all expenses of defense, and indemnify hold harmless the City, and its officers employees, from all claims, loss, damage, injur] liability of every kind, nature and descript directly or indirectly arising from or in connec with the performance of the Permit or from failure or alleged failure of the Operator to cc with any applicable law, rules or regulat including those relating to safety and hea except for loss or damage which was caused sc by the active negligence of the City; and fron and all claims, loss, damage, injury and liabil howsoever the same may be caused, resulting dirc or indirectly from the nature of the work, ur 6 0 0 the loss or damage was caused solely by the act negligence of the City. The expenses of defe include all costs and expenses, including attorne fees for litigation, arbitration, or other disp resolution method. 12. Insurance. Without limiting the Operatc indemnification, the Operator shall maintain force at all times during the tenure of this Pern a policy or policies of general liability insurz coverage with limits in the amount of at le $5,000,000.00 covering its operation to incl coverage for contractual liability, and covering liability stated under the foregoing paragrz glIndemnityll. The policy or policies contain following clauses: A. "The City is added as an additional insurec respects operations of the named insured.' B. "It is agreed that any insurance maintainec the City shall apply in excess of and contribute with, insurance provided by 1 pol icy. I) All insurance policies required by this paragraph shall contain following clauses: A. "This insurance shall not be cancelled, lim or non-renewed until after thirty (30) t written notice has been given to the City B. 'IThe insurer waives any rights of subroga it has or may have, against the City or an its officers or employees." Certificates of insurance evidencing the coverages required by clauses set forth above shall be filed with the City's Management Office prior to the effective date of this Permit. B. Prohibitions The following actions are prohibited at this Facili 7 0 0 1. Receipt of hazardous or toxic waste. 2. Receipt of liquid waste. 3. Receipt of flammable waste or fuel containe 4. Receipt of explosive devices. 5. Receipt of large dead animals. 6. Receipt of infectious waste. 7. Receipt of radioactive waste. 8. Scavenging. 9. Receipt of waste water treatment plant products, such as: sludge, grit, screenings, or digester cleanings. 10. Allowing or maintaining a rodent harborage, vermin infestation. 11. Maintaining a public nuisance as determinet the LEA. 12. Smoking or other ignition sources on tipping floor, receiving area, processing ar or combustible storage areas. 13. Use of the facility by trash hauler other t the Operator. 14. Other actions, upon reasonable notice Operator, determined by the LEA to detrimental or injurious to the health safety of the residents of the LEA. C. Specifications 1. No significant change in design or opera1 of the Facility from that described in "Report of Station Informationt*, revised Mz 1988, and Item A of the Findings of this pel is allowed, except those changes required UI the Conditions portion of this permit. 2. This Facility has a permitted capacity of tons of solid waste per operating day and SI not receive more than 400 tons of solid w4 8 0 0 per operating day without a revision of t permit. 3. Activity of persons in this Facili especially on the tipping floor, shall be ur constant supervision by the Operator who sk require strict adherence to all Health Safety Rules. The Operator shall take reasonable and prudent measure necessary insure the health, safety and well-being each person who uses this Facility. 4. The Operator shall properly supervise employees and require all employees to uti1 appropriate safety equipment such as hard h; safety vests, ear protection, respirat protection or other safety gear as necess; 5. Resource recovery and/or salvage activil shall be conducted only by employees of Operator in an organized manner under prc supervision. 6. The Operator shall provide all weather acc roads maintained in repair and safe condit: 7. The Operator shall direct traffic flow to a' crossing or unsafe patterns. 8. The Operator shall maintain the surface of tipping floor and other surfaces in a smoc easily cleanable condition which affords a 1 skid walking surface. The surface of tipping floor and other surfaces shall maintained in good repair: such that lil will drain completely from the surface and ' not collect in cracks, pits, or depressio 9. The Operator shall control dust and airb particulates by appropriate means to pre a health hazard or a nuisance. 9 0 e 10. The Operator shall provide adequate ventilat to prevent accumulation of internal combust engine fumes in the enclosed receiT building. 11. The Operator shall use reasonable methods prevent a noise health hazard or nuisancc all areas. 12. Litter shall be confined to the immediate ; of the tipping floor. 13. The Operator shall remove litter and st waste along the access road to and incluc the intersection with El Camino Real, in City right-of-way southbound on El Camino 1 from access road to and including intersecl of Palomar Airport Road, in the City right. way eastbound on Palomar Airport Road to easterly City boundary, and from : contiguous with the Facility whenever the 1 exists and at least once per week. 14. All equipment, appurtenances, floors, wa: ceilings, and other surfaces shall constructed and maintained in a manner wl can be easily cleaned and shall be kept c: to an extent reasonable for this type Facility. 15. The Facility shall be designed, constructed operatedtopreventthe introduction, harbo: or propagation of rodents, flies or 0' vermin. 16. The Operator shall arrange rou surveillance, eradication, and control vermin and rodents at the Facility b Certified Pest Control Operator. 10 0 e 17. All storage on the Facility premis especially the storage of recyclables, sh be maintained in a manner which will not har vermin. The stored materials must maintained a minimum of 12 inches from fen or walls with adequate aisle space to a1 safe inspection. 18. All recyclables shall be removed from Facility within thirty (30) days from accumulation date unless written approval exceed this time limit is obtained from LEA. 19. The Operator shall maintain a daily log of following information: fires, injury, prope damage, accidents, explosions, discharge prohibited waste, flooding, and other unus occurrences. This log shall be available review during operating hours and complc logs shall be kept for five (5) years. 20. The Operator shall submit copies of repc required by other agencies with regulat control or authority over Operator to the at the time of their submission. 21. The Operator agrees that ingress and egres: the facility shall be by way of Faraday DI on the North and by El Camino Real on the Wc Ingress and egress by way of El Camino I shall be limited to right turns in and r: turns out, only, i. e. ingress and egress crossing the painted center median on El Cal Real is expressly prohibited. D. Provisions 1. This permit is subject to review by the : and may be subject to suspension, revoca' 11 e e or modification whenever the conditions applicable permits are not met or is subj to suspension, modification or revocation u grounds set forth in Government Code Sect 66796.33.. 2. The Operator shall establish a writ contingency plan which will provide operat procedures and instructions to workers for recognition, safe handling, storage, disposal of infectious, toxic, hazardous, radioactive waste in the event these mater: are encountered. The Operator shall suspend waste recei. operations when notified by the LEA thai emergency, potential public health hazard public nuisance exists. 5. The Operator shall remove any discovered w or material received in violation of permit to an approved location at Operator's expense. 6. All waste water generated by the Facility s be disposed through an approved sewe system. 12 * * 7. The Operator shall forward to the LEA wit ten (10) calendar days, copies of complaints received regarding the operation the Facility. E. Self Monitorinq The Operator shall submit a quarterly report to LEA of the following records: 1. Weight or volume of waste received per day per week. 2. Weight or volume and types of material recyc per week and per month. 3. Number and type of vehicles utilizing Facility per day and per week. 4. Weight or volume of nonprocessible resi disposed of per day and per week and the r and location of the disposal site receiving waste. 5. Types and quantities of hazardous, infectic radioactive, or prohibited waste found incoming waste and the disposition of tl materials. 13
