HomeMy WebLinkAbout1988-10-04; City Council; Resolution 88-359-7- .&' l a 0 , II 1 2 3 RESOLUTION NO. 88-359 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DETERMINING UNPAID ASSESSMENTS IN A SPECIAL ASSESSMENT DISTRICT 4 11 WHEREAS, the CITY COUNCIL of the CITY OF CAR 5 6 CALIFORNIAl has heretofore undertaken proceedings pursuant "Municipal Improvement Act of 1913", being Division 12 I 7 8 9 Streets and Highways Code of the State of California, ar confirmed assessments upon lands within a special asse district described in a Resolution of Intention prev 10 11 adopted for said improvements, said special assessment Di known and designated as ASSESSMENT DISTRICT NO. 86-1 (P I-2 I/ AIRPORT ROAD) (hereinafter referred to as the "Asse! 13 11 District"); and, 14 11 WHEREAS, said proceedings provided for the issuance of 15 11 pursuant to the "Improvement Bond Act of 1915", being Divis l6 II of the Streets and Highways Code of the State of Californi< 1711 it is necessary to establish the unpaid amount of assessmen I-8 I1 the purpose of issuing bonds; and, 19 20 21 22 23 24 25 26 27 28 WHEREAS, notice of the recordation of the assessment , the time within which assessments may be paid in cash ha: duly published and mailed in the manner provided by law, a: time so provided for receiving payment of assessments in ca expired, and there has been filed a list of all assessments now remain unpaid; and, WHEREAS, said complete list represents all payments ret on unpaid assessments, as well as any applied credits or , tionments as may be necessary to correctly reflect the . balance of assessments. II . z 0 0 1 1 2 NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: 3 11 SECTION 1. Recitals. That the above recitals are a1 4 )I and correct. 5 11 SECTION 2. Unpaid Assessments. That the assessmen 6 II remaining unpaid, and the aggregate thereof, are as show] 7 8 9 10 11 12 list entitled "Paid and Unpaid Assessments", referenced name of this Assessment District, a copy of which is on f the Office of the Treasurer and by reference made a part her SECTION 3. Parcel Descriptions. That for a part description of the lots or parcels of land bearing the resr assessment numbers set forth in said Unpaid List and upon 13 assessments remain unpaid, reference is hereby made to the a 14 ment and to the diagram recorded in the Office of the Super 15 16 17 18 dent of Streets. SECTION 4. Issuance of Bonds. Collection of Assessments.
