RESOLUTION NO. 89-192
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA APPROVING
AMENDED AGREEMENTS BETWEEN THE FIELDSTONE/ LA COSTA ASSOCIATES AND THE CITY OF
CARLSBAD; AND, THE CITY OF CARLSBAD AND
STA, INC. FOR PREPARATION OF AN
ENVIRONMENTAL IMPACT REPORT FOR THE MASTER
PLAN PROJECT
The City Council of the City of Carlsbad, Califorl
does hereby resolve as follows:
1. That certain agreements between the City
Carlsbad and the Fieldstone/La Costa Associates; and the C
of Carlsbad and STA, Inc., for the augment of services for
environmental impact report for the Master Plan project, co~
of which are attached hereto marked Exhibits I1A1' and
incorporated herein by reference, are hereby approved.
2. That the Mayor of the City of Carlsbad is her
authorized and directed to execute said agreements for and
behalf of the City of Carlsbad.
PASSED, APPROVED AND ADOPTED at a regular meeting
the City Council of the City of Carlsbad, California held

THIS SUPPLEMENTAL AGREEMENT is made this 20th day of 'June
1989, between the CITY OF CARLSBAD, a municipal corporation of the State
Cal ifornia, hereinafter referred to as CITY, and the FIELDSTONE/LA C(
ASSOCIATES (La Costa Ranch Company) hereinafter referred to as APPLTCI
pursuant to Article 4, of that certain agreement between the parties dated t
9, 1986, which is on file with the City Clerk ("original agreement")
supplemental agreement dated August 25, 1988 ("supplemental agreement"). Ex(
as set forth below, all terms and conditions of the Original & Supplemer
Agreement shall remain in effect for the balance of the term of this Agreemt
The original agreement and supplemental agreement shall
supplemented and amended by the provision of additional funding in the amc
of $59,903.00 for completion of additional work by consultant.

AGREEMENT
THIS SUPPLEMENTAL AGREEMENT is made this 20th day of June
1989, between the CITY OF CARLSBAD, a municipal corporation of the State
California, hereinafter referred to as CITY, and STA, Inc. hereinafter referr
to as CONSULTANT, pursuant to Article 9, "Changes in Work" of that certa
agreement between the parties dated August 4, 1986, which is on file with t
City Clerk ("original agreement") and Supplemental Agreement dated August 2
1988 ("supplemental agreement"). Except as set forth below, a1 1 terms a
conditions of the original agreement and supplemental agreement shall remain
effect for the balance of the term of this Agreement.
The original agreement and supplemental agreement shall I
supplemented and amended as provided for below:
As of May 16, 1989, $76,262.50 has been paid to STA, Inc. for tl
preparation of the environmental impact report for the Arroyo La Costa Mastc
Plan. The remaining $59,903.00 shall be paid in the following manner:
1. Up to $43,023.00 shall be paid within 15 days of the receil
of invoice for work completed.
2. $5,940.00 shall be paid within 15 days of receipt of Respon:
to Comments documents.
3. $5,940.00 shall be paid within 15 days of receipt of invoic
after final City approval of the environmental impact report.
4. $5,000 shall be kept as a contingency fund which shall only t
paid upon written request from the consultant showing additional City authorizc
time and materials and written authorization of the Planning Director of the Cit
of Carlsbad. All funds remaining after the final approval of the EIR shall I:
returned to the applicant.
