RESOLUTION NO. 89-194
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, CONFIR,MING THE DIAGRAM
AND ASSESSMENT AND PROVIDING FOR THE LEVY OF
THE ANNUAL ASSESSMENT IN A SPECIAL MAINTENANCE
DISTRICT
WHEREAS, the CITY COUNCIL of the CITY OF CARLSE
CALIFORNIA, has initiated proceedings for the levy of the an:
assessment for a landscaping and lighting district cre
pursuant to the terms of the "Landscaping and Lighting Ac?
1972", being Division 15, Part 2 of the Streets and High
Code of the State of California (the "Act"), in a special mai
nance district known and designated as STREET LIGHTING
LANDSCAPING DISTRICT NO. 1 (hereinafter referred to as
"District") ; and,
WHEREAS, at this time a public hearing has been held in
manner and form as required by the Act, and this City Counci
now satisfied with the assessment and diagram and all c
matters as contained in the Engineer's "Report" as now submi
for final consideration and approval.

NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
RECITALS
SECTION 1. That the above recitals are all true
correct.
PROTESTS
SECTION 2. That all protests and objections of every
and nature be, and the same hereby are, overruled and denied

SECTION 3. That the final assessment and diagram fo
proceedings, as contained in the Engineer '8 "Report", is h
approved and confirmed.
SECTION 4. That the public interest and conven

SECTION 5. That the assessments contained in said "RE

FILING AND RECORDING

ment shall be filed in the Office of the City Clerk, w

SECTION 7. That the City Clerk is hereby ordere
directed to immediately file a certified copy of the diagra

ENTRY UPON THE ASSESSMENT ROLL
SECTION 8. That after the filing of the diagram and ass€
ment, the County Auditor shall enter on the County assessr
roll opposite each lot or parcel of land the amount asse
thereupon, as shown in the assessment.
COLLECTION AND PAYMENT
SECTION 9. The assessments shall be collected at the
time and in the same manner as County taxes are collected,
all laws providing for the collection and enforcement of Cc
taxes shall apply to the collection and enforcement of
assessments.
PASSED, APPROVED AND ADOPTED by the City Council of
City of Carlsbad at its regular meeting held on the 20th
of June , 1989, by the following vote, to wi.
