CALIFORNIA, ACCEPTING A GRANT DEED AND SUBORDINATION AGREEMENT FOR WATERLINE PURPOSES OFFSITE OF CARLSBAD TRACT 85-35.
WHEREAS, Aviara Land Associates Limited Partnership has submitted
Deed conveying an easement to the City of Carlsbad for Waterline Easeme
purposes over a portion of Section 27, Township 12 South, Range 4 W
Bernardino Meridian; and
WHEREAS, the City Council of the City of Carlsbad has determined
the public interest to accept said Deed;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of C
California, as follows:
1. That the above recitations are true and correct.
2. That the Grant Deed from Aviara Land Associates Limited Par
dated June 7, 193, conveying an easement for water1 ine purpose
portion of Section 27, Township 12 South, Range 4 West, San Bernardino
to the City of Carlsbad which is on file with the City Clerk and incc
herein by reference, is accepted.
3. That the Subordination Agreement from First Interstate Bank
Cal i forni a dated June 7 , 193 approving an easement for waterli
purposes over a portion of Section 27, Township 12, Range 4 West, San Bc
Meridian, and subordinating the lien of the deed of trust to the easemc
file with the City Clerk and incorporated herein by reference, is accel

4. That City Clerk is authorized to cause the original Dl
Subordination Agreement to be recorded in the Office of the County Recc
San Diego, State of California, with the appropriate Certificate of Acc
attached.
