RESOLUTION NO. 89-204
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING A GRANT DEED AND SUBORDINATION AGREEMENT FOF
C OFFSITE, PR 3.3.12.
DRAINAGE AND SEWER EASEMENT PURPOSES AVIARA CT 85-35 PHASE I UNIl
WHEREAS, Aviara Land Associates Limited Partnership has submitted i
Deed conveying an easement to the City of Carlsbad for Drainage and
purposes over a portion of Section 27, Township 12 South, Range 4 Wes
Bernardino Meridian in the City of Carlsbad, County of San Diego, St
California; and
WHEREAS, the City Council of the City of Carlsbad has determined
in the public interest to accept said Deed;
NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of the Ci
Carlsbad, California, as follows: : 1. That the above recitations are true and correct.
2. That the Grant Deed from Aviara Land Associates Limited Partnt
dated JUW 14 , 1989, conveying an easement for Drainage and Ea: 15

purposes over a portion of Section 27, Township 12 South, Range 4 Wesl
Bernardino Meridian to the City of Carlsbad which is on file with thc
Clerk and incorporated herein by reference, is accepted.
3. That the Subordination Agreement between Aviara Land Assoc
Limited Partnership and First Interstate Bank of California dated JIIflE I
1989 approving an easement for Drainage and Sewer purposes over a porti
Section 27, Township 12 South, Range 4 West, San Bernardino Meridian
subordinating the lien of the deed of trust to the easement is on file wii
City Clerk and incorporated herein by reference, is accepted.

4. That City Clerk is authorized to cause the original Dee(
