I! 0 0 !I 1 2 3 RESOLUTION NO. 89-265 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADOPTING A MEMORANDUM OF UNDERSTANDING BETWEEN REPRESENTATIVES OF MANAGEMENT AND THE CARLSBAD CITY EMPLOYEES' ASSOCIATION. 4 11 WHEREAS, representatives of management and the Carlsbad !j // City Employees' Association, have been conducting 6 11 negotiations pursuant to the Meyers-Millias-Brown Act, 7 // regarding wages and other terms and conditions of employment 8 9 10 11 12 13 14 15 16 17 for the period July 10, 1989, through June 30, 1991: and WHEREAS, said representatives have reached agreement which they desire to submit to the City Council for approval; and WHEREAS, the City Council has determined it to be in the public interest to accept such an agreement in the form of a Memorandum of Understanding, marked Exhibit A and incorporated by reference herein: WHEREAS, funds fcr this salary adjustment are available in the City's contingency account and other fund balances. 18 19 NOW, THEREFORE, BE IT RESOLVED by the City Council for lthe City of Carlsbad, California, as follows: 2o 11 1. That the above recitations are true and correct. 21 22 23 24 2. That the Memorandum of Understanding between the Carlsbad City Employees' Association and representatives of management is hereby accepted. 3. That the Miscellaneous Salary Schedule set forth 25 26 28 27 I in Exhibit B, attached hereto and made a part thereof, is adopted. Ill e 0 1 3 4. RAUTENKRANZ, City Clkk 18 (SEAL) ii 19 20 21 22 I ! 23 24 25 27 26 ~ 28 0 0 EXHIBIT A HEHORANDUH OF UNDERSTANDING between the City of Carlsbad and the Csrlsbad City Employees' Assoclatlon This Memorandum of Understanding is made and entered into between designated management representatives of the City of Carlsbad (hereinafter referred to as the "City"), and the designated representatives of the Carlsbad City Employees' Association (hereinafter referred to as CCEA). Preamble It is the purpose of this Memorandum of Understanding (hereinafter referred to as 'Memorandum') to promote and provide for harmonious relations, cooperation, and understanding between the City Management representatives and the miscellaneous employees covered under this Memorandum, as shown on Attachment A; to provide an orderly and equable means of resolving any misunderstandings or differences which may arise under this Memorandum; and ta set forth the agreement of the parties reached as a result of good faith negotiations regarding wages, hours, and other terms and conditions of employment of the employees covered under this Memorandum, which agreement the parties intend to jointly submit and recommend to the City Council for its determination. Article 1 Recognition The City of Carlsbad recognizes KEA, as representative for all classifications in this Unit, as set forth in Attachment A. Article 2 implementation This Memorandum constitutes a mutual recommendation to be jointly submitted to the City Council subsequent to the ratification of the Memorandum by the membership of CCEA. It is agreed that this Memorandum shall not be binding upon the parties either in whole or in part unless and until: A. The City Council acts, by majority vote, formally to approve and adopt said Memorandum; or 6. The City Council acts to appropriate the necessary funds required to implement the provisions of this Memorandum; or C. The City acts in a timely manner to make the changes in City ordinances, resolutions, rules, policies and procedures necessary to implement this Memorandum. Article 3 Term The term of this Memorandum shall commence on the date when the terms and conditions for its effectiveness, as set forth in Implementation, are fully met. This Memorandum shall expire and otherwise be fully terminated at 12:OO midntght an June 30, 1991. e 0 Article 4 Renegotiation A In the event either party desres to meet and confer in good faith on the pravrsions of a Successor Memorandum, either Party shall serve upon the other party, during the period from December 1, 1990 to February 1, 199 1, its written request to commence meting and conferring ir! good faith. Upon receipt of such written notice, meet and !confer in good faith shal! begin QO later than April 1, 1991 e. Unless the City serves upon the employees by proposals to amend, add to. delete, or otherwise change any of the provisions of the Memorandum, this Memorandum shall constitute City'; full proposal for a successor agreement. Upon receipt of such notice and proposals, meet and confer shall begin no later than April 1, 1991. Notwithstanding the above, if federal or state governments take action that has direct effect upon areas which fal! within meet and confer, the City may submit proposals concerning these areas at later dates. C, If neither party requests a reopening for the purpose of renegotiation, all conditions of this Memorandum remain in full force and effect for one year from the data it would have terminated as set forth in Article 3, Term, unless either party gives thirty (30) days notice lo terminate subsequent to June 30, 1992. Article 5 Retention of Benefits The employees of the City of Carlsbad shall retain all present benefits for the term of this agreement, except as amended by this Memorandum. Article 6 City Rights The rights of the City include, but are not limited to the exclusive right to determine mission of its constituent departments, commissions, boards; set standards of service; determine procedures and standards of selection for employment and promotion; direct its employees; take disciplinary action; relieve its employees from duty because of lack of work or other legitimate reasons; maintain the efficiency of government.al operations; determine the methods, means, and personnel by which government operations are to be conducted; determine the content of job ciassifications; take ail necessary actions lo carry out its mission in emergencies; and exercise complete control and discretion over its organization and the technoiogy of performing its work. Article 7 No Strike and No Lockout A. No Strike. During the life of this Agreement, neither the employees nor any agents or representatives will instigate, promote, sponsor, engage in, or condone any strike (including sympathy strike), slowdown, concerted stoppage of work, sickouts, or any other Intentional disruption of the operations of the City, regardless of the reason for ' so doing, B. Penalty. Any employee engaging in activity prohibited by Article 7. A., or who instigates or gives leadership to such activity, shall be subject to disciplinary action. C. No lockout. During the term of this Agreement, the City will not instigate a lockout over a dispute with the Employees so long as there is no breach of Section ?.A. D. Association Official Responsibility. Each employee who holds the position of officer of the Employee Association occupies a position of special trust and responsibility in maintaining and bringing about compliance with the provision of this Article, the -2- 0 0 employees agree to inform ~ts members of their obligations under this Agreement and to direct them to return to work. Article 8 Compensation Adjustments A. Annual Salary adjustments. Salary increases in accordance with the schedule below will be made, effective the first pay period begining in the month indicated, for a!! represented Classifications by applying the Increase to Step A of the New Saiary Range Schedule. July, 1989: 5% + Lump Sum Payment as provided for in Section C. July, 1990. 4% January, 199 1 ~ 2% 8. Salary Range Schedule. Effective the first pay period in July, 1989, the Salary Range Schedule attached hereto (Attachment B) shall be implemented. Employees in existing salary ranges shall be placed into the new ranges in the same Step that they are in currently, The annual salary adjustment, effective the first pay period in July, 1889, shall then be applied to the new salary range schedule and a new Attachment 6 will be established. C. Lump Sum Payments. In the same pay period the July 1989 salary increase 1s implemented, the City shall provide each employee represented by this agreement a special one-time lump sum payment in accordance with the schedule below. The following is based on the Employee Salary Range Placement listing dated July 12, 1989. Note this list will be up-dated to reflect the agreed to adjustment and current emplovee status. 1, Those employees receiving a salary increase with a Percent Change that is jess than 3.5% shall receive a lump sum payment of $900. 2. Those employees receiving a salary increase with a Percent Change that IS 3.5% but less than 3% shall receive a lump sum payment of $775. 3. Those employees receiving a salary increase with a Percent Change that is 4% but less than 5% shall receive a lump sum payment of $515. 4. Those employees receiving a salary increase with a Percent Change that is 5% but less than 6% shall receive a lump sum payment of $260. D. Tool Allowance. The City will meet informally with the Equipment Mechanics for the purpose of developing a personal tool usage & allowance policy. As a part of this policy, the City will establish an annual tool ailowance for employees to purchase and maintain personal tools used in the normal course of employment on City premises. Article 9 Health Insurance Program A. The current plans known as "Kaiser" and "Northwestern" which provide medical, dental and vision coverages for employees and their dependents will continue to be available to employees during the term of this Memorandum. If a change in insurance carrier is necessary, as determined by the City, the City will notify KEA. E. Article 11 Annual Vacation Leave The foliowing shall be the annual vacation leave schedule: 1 through 5 full calendar years of continuous service - 10 working days 5 through 10 full calendar years of continuous service - 15 working days 10 LhrouGh 1 1 full calendar years of continuous service - 16 working days 1 I through 12 full calendar years of continuous service - 17 working days 12 through 13 full calendar years of continuous service - 18 working days 13 through 14 full calendar years of continuous service - 19 working days 14 through 15 futl calendar years of continuous service - 19 working days 16 and over full calendar years of continuous service - 20 working days Article 12 Bereavement Leave A, An employee may use up to 24 hours of paid leave if required to be absent from duty due to the death of a member of the employee's immediate family. Additional time off may be authorized by the department head and charged to accrued vacation or treated as ieave without pay. The "immediate family" shall be defined as: Spouse, chlld, parent, stbliny, grandparents; the aforementioned either natural, step or in-law, or any person Over which the employee acts as legal guardian, or a verifiable current member of the immediate household. B. The employee may be required to submit proof of relative's death before final approval of leave with pay IS granted. Article 13 Association Deductions Parties agree that upon formal notice from KEA and employee authorization, the City shall withhold deductions in amounts designated by CCEA members providing changes do not occur more frequently than once each fiscal year. Article 14 State Disability insurance The Ciky agrees to continue premium payments for state disability insurance during the term of this agreement. Article 15 Holidays A. The City shall observe eleven (1 1) scheduled paid holidays plus one (1 f floating holiday for employees assigned to eight-haurs-per-day-five-days-per-week workweeks, and nine (9) scheduled holidays plus one (1 1 floating holiday for employees -4- e e assigned to ten-hours-perday-four-days-per-week workweeks. The floating holiday may be used at the discretion of the employee with prior approval of the Department Head. B. The scheduled paid holidays that will be official City holidays for the term of this agreement shall be as follows: New Year‘s Day Columbus Day Llncoln’s Blrthday Veteran’s Day Washington’s Birthday Thanksgiving Day Memorial Day Thanksgiving Friday independence Day Christmas Day Labor Day The City shall annualiy develop and publish a holiday schedule which will identify the specific days on which the above holidays will be observed as official City holidays and whlch days will not be observed for employees on ten-hours-perday-four-days-per- week workweeks. Articlr 16 Full Understanding. Modification. Waiver A, This Memorandum of Understanding sets forth the full and entire understanding of matters contained herein, any other prior or existing understanding or agreements by the parties, whether formal or informal, regarding any such matters are hereby superseded or terminated in their entirety. 8. It is the intent of the parties that this Memorandum of Understanding be adrnlnistered in its entirety in good faith during its full term. During the krm of this agreement it may be necessary for the City to make changes relative to the hours, wages, terms and conditions of employment or changes in rules or procedures affecting the employees covered by this agreement. Where the City finds it necessary to make such changes, it shali notify CCEA indicating the proposed change prior to its implementation. If CCEA wishes ta consult or meet and confer with the City regardlng the matter, CCEA shall notify the City withln five (51 working days from the receipt of such notice. Upon receipt of such notice, the parties shall meet promptly in an earnest effort to reach a mutually satisfactory resolution of any problem arising as a result of the change instituted by the City. Where the City makes such changes because of the requirements of the law, the City shall not be required to negotiate the matter of compliance with any such law. Nothing herein shall limit the authority of the City to make such changes required during emergencies. However, the City shell notify CCEA of such changes as soon as practicable. Such emergency assignments shall not extend beyond the period of emergency, ‘Emergency’ shall be defined as an unforeseen circumstance requiring immediate implementation of the change. C. Failure by CCEA to request consultation as negottations, pursuant to Paragraph 8, shall not be deemed as approval of any action taken by the City. D, Except as specifically provided herein in paragraph B, it is agreed and understood that each party hereto voluntarily and unqualifiedly waives its right, and agrees that the other shall not be required, to negotiate with respect to any other matters within the scope of negotiations, during the term of thls Memorandum of Understanding. -5- 0 0 E. Any ogreernent, oltoration, understanding, variation, waiver or modification of any of the terms or provisions contained herein shall not be binding upon the partles hereto unless made and executed in writing by all parties hereto, and if required, approved and implemented by the City Council. F. The waiver of any breach, term or condition of this Memorandum of Understanding by either party shall not constitute agreement or precedent in the future enforcement of all its terms and provisions. Artlele 17 Authorlzed Agents For the purpose of administering the terms and provisions of this Memorandum of Understanding: A. City's principal authorized agent shall be the City Manager or a duly authorized representative (Address: 1200 Elm Avenue, Carlsbad, California 92008; Telephone (619) 434-2859), except where a particular City representative is specifically designated in connection with the performance of a specific function or obligation set forth herein. 6. CCEA authorized representative shall be its President or duly authorized representative (Address: P.O. Box 2056, Carlsbad, California 92008; Telephone (619) 729-8128). Article 18 Provisions of L8w It is understood and agreed that this Memorandum of Understanding is subject to all current and future applicable federal and state laws, federal and state regulations. If any part or provision of the Memorandum of Understanding is in conflict or inconsistent with such above applicable laws, rules and regulations, or is otherwise held to be invalid or unenforceable by any tribunal or competent jurisdiction, such part or provision shall be suspended and superseded by such applicable law or regulations, and the remainder of this Memorandum of Understanding shall not be affected thereby.
