A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING A RIGHT OF ENTRY
AND A GRANT OF EASEMENT AND APPROVAL OF AN AGREEMENT
BETWEEN THE CITY AND HUGHES NORTH COUNTY ASSOCIATES
AND HUGHES NORTH COUNTY ASSOCIATES I1 FOR
MAINTENANCE OF THE BUENA VISTA CHANNEL AND
AUTHORIZING THE MAYOR TO EXECUTE THE AGREEMENT ON
BEHALF OF THE CITY

6 WHEREAS, Hughes North County Associates and Hughes Nortl

existing properties, San Diego County Assessor's parcels 156- 9
grant of easement for channel maintenance purposes over theil 8
County Associates I1 have submitted a right of entry and i
10 120-56 and 156-301-15, and requested Councils approval of a]
11 agreement for maintenance of a portion of the Buena Vistz
12 Channel and authorized the Mayor to sign the agreement: and,

WHEREAS, the City Council of the City of Carlsbad ha:
determined it in the public interest to accept said document:
15 and approve said Agreement:

NOW, THEREFORE, BE IT RESOLVED by the City Council of thc
1. That the above recitations are true and correct.
2. That the right of entry dated July 10, 1989, and thl 19 i

PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 1st day of
