RESOLUTION NO. 89-289
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA AUTHORIZING
THE EXECUTION OF AN AMENDMENT TO THE
CONSULTANT AGREEMENT FOR CONSTRUCTION
ADMINISTRATION OF THE CARLSBAD SENIOR
CENTER TO INCREASE THE PAYMENT TO THE
CONSULTANT
The City Council of the City of Carlsbad, California,
hereby resolve as follows:
1. That an increase for additional consultant fees ir
amount of $15,000 is hereby approved.
2. That an amendment between the City of Carlsbad and
Darrell E. Waters for Construction Administration Services, a
of which is attached as EXHIBIT 'lA" and incorporated herej
reference is hereby approved.
3. The Mayor of the City of Carlsbad is hereby authorize
directed to execute said agreement for and on behalf of the
of Carlsbad.
PASSED, APPROVED, AND ADOPTED at a regular meeting of thc
of Carlsbad City Council held on the 15 th day of
August , 1989, by the following vote, to wit:

AMENDMENT TO AGREEMENT FOR
ENGINEERING SERVICES
AMENDMENT NO. 1
This Amendment to the Agreement between the parties dated
February 1, 1989 is made and entered into as of the 2 ]ST
day of ~~L(GUST , 1989.
The parties agree that paragraph 4 of the Agreement is amended
to read as follows:
4. PAYMENT OF FEES
The total fee payable including this Amendment shall not
exceed $25,000. Payments shall be made per Paragraph 3 of the
original agreement and as shown on Exhibit IrA11 attached hereto and
made a part hereof.
Except as provided herein, no other compensation for services
shall be allowed except for items approved by supplemental
agreements executed pursuant to Paragraph 3.
This amendment shall be effective on and from the day and year
first above written.
IN WITNESS WHEREOF, we have hereunto set our hands and seals.

EXHIBIT "A"

CONSULTANT COMPENSATION
a. Under the general direction of the Municipal Projects
Department and subject to the provisions of Section 1(
of this agreement, the City shall compensate Consultanl
for construction administration services in accordancc
with the terms, conditions, and services as set fort1
herein. The hourly rate for the Consultant shall bt
$115.00 per hour to include travel time to and fro1
required meetings. Additionally, if required an(
authorized in advance by City, Consultant shall providc
a Scheduling Engineer at the rate of $62.50 per hour wher
required to support Consultant's services. Said
compensation shall be expressly limited to time actual11
at the City offices, on the project site, in the field,
or working at the Consultant's offices on behalf of the
City of Carlsbad. All Consultant hours, regardless of
the total number per day or per week during the course
of accomplishing these services, shall be compensated at
the above referenced rate. In no event shall the total
compensation to Consultant for all services and expenses
including those required of a Scheduling Engineer as
described above, exceed $25,000.00 without the express
written approval of the City.
b. It is understood by the parties to this agreement that
the aforementioned hourly rate shall be considered to be
the compensated rate for the duration of the project.
The Consultant warrants that no adjustments in hourly

rate shall be requested during the term of this
' agreement.
c. Transportation costs for the use of Consultant's
automobile required during the course and scope of these
services shall be compensated at the rate of $0.225 per
mile.
d. Additional expenses related to this agreement for
meetings and other expenses required to perform said
services shall be reimbursed by the City on the basis of
actual cost where specifically approved in advance by the
City and upon submission of itemized invoices to the City
of Carlsbad.
