PCD 89-3 - NESSIM WHEREAS, an application for a building remodel was sub] to the City of Carlsbad for property located at 2986 Highland A’ 7 and WHEREAS, the application was denied by the Planning Di 8 9 16 11 12 13 14 15 16 17 18 because it exceeded the height limit of the R-1 Zone: and WHEREAS, the applicant appealed to the Planning Comm which also denied the request because the proposed building ex the height permitted in the R-1 Zone: and WHEREAS, the applicant has appealed the decision c Planning Commission to the City Council. NOW, THEREFORE, BE IT RESOLVED by the City Council of tk: of Carlsbad, California, as follows: A) That the above recitations are true and correct. B) That based on the evidence presented, the City Council the appeal of PCD 89-3 based on the following findings I 19 Findincrs: 1 20 21 22 23 24 25 26 1. That the four-story, 39 foot remodeled building does not me intent of the R-1 zone because it exceeds the 35 foot height and the number of stories that other single family structurc in this zone. 2. That the proposed height is inconsistent with the Land Use I of the General Plan in that it does not meet the goals and pc provided in this document.
