HomeMy WebLinkAbout1989-11-21; City Council; Resolution 89-412" I1 e 0 1 2 3 RESOLUTION NO. 89-412 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD ~ CALIFORNIA, GRANTING A STANDARDS VARIANCE FOR ADAMS STREEl I BETWEEN HARRISON STREET AND PARK DRIVE. ~ 4 I1 5 /I WHEREAS, City Council has requested that staff investigate the possik 6 developing a special hillside standard for Adams Street between Harrison Street a] 7 9 WHEREAS, staff has developed alternative standards for the portion of 8 Drive; and 10 WHEREAS, the Planning Commission has voted to recommend that the 1. 11 12 design width for that portion of Adams Street be reduced and that concrete used 5 13 and gutter be colored. 14 15 3.6 Street which are acceptable to the City from a liability standpoint; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the Carlsbad as follows: 17 /I A. That the above recitations are true and correct. 18 B. That the City Council approves reducing the curb to curb width on 19 Street between Harrison Street and Park Drive from 40 feet to 34 feet, allowin; 2o 1 encroachments into the public right-of-way and ordering the use of colored coria 21 22 curb, gutter and sidewalk improvements. That approval of SV 89-01 is granted based on the following findil 1. That there are extraordinary or unusual circumstances or COI applicable to the situation of surrounding property necessil variance of the standards. 2. That the granting of such variance will not cause substantial d problems. 3. That the granting of such variance will not significantly cod: existing or future traffic and parking demands or pedestrian 01 use. 4. That the granting of such variance will not be detrimental public welfare or injurious to the property or improvement: vicinity in which the variance is granted. 5. That the granting of such variance will not adversely aff comprehensive general plan.
