HomeMy WebLinkAbout1990-01-16; City Council; Resolution 90-10" .. ll 1 2 0 e RESOLUTION NO. 90 - 10 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, MAKING FINDINGS ON PETITION. 3 4 WHEREAS, the City Council of the City of Carlsbad, California, has now been prc 5 certain property owners an updated and executed Petition requesting the construction 6 public improvements, together with appurtenances and appurtenant work in connection 7 California, in a special assessment district known and designated as ASSESSMENT DIS': 9 Improvement Act of 1913", being Division 12 of the Streets and Highway Code of tl- 8 said improvements to be constructed pursuant to the terms and provisions of the ' lo // 88-1 (Alga Road) (hereinafter referred to as the "Assessment District"); and, 11 12 13 14 WHEREAS, it is now reported that said Petition contains the signatures of interes and property owners as authorized, and the Petition now meets the requirements of Di the Streets and Highways Code of the State of California. 15 II NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: 16 17 SECTION 1. That the above recitals are all true and correct. SECTION 2. That it is hereby found that said Petition has been signed by owners 01 18 proposed Assessment District. 19 constituting more than sixty percent (60%) of all assessable land within the bounda 20 SECTION 3. That said Petition shall be filed with the transcript of these proceeding 21 22 23 24 25 26 27 SECTION 5. This legislative body hereby further finds and determines, based 28 evidence submitted, that the total estimate amount of the proposed assessments will remain open to public inspection. SECTION 4. That said Petition meets the requirements of Section 2804 of Divisic Streets and Highways Code of the State of California, and further proceedings and under the provisions of the "Special Assessment Investigation, Limitation and Majority of 1931" shall not be applicable to these proceedings. e m 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 seventy-five percent (75%) of the estimated fair market value of the land proposed to bf after the proposed public improvements shall have been constructed. SECTION 6. That it is hereby further determined and found that said Petition has be by not only the property owners, as specified in Section 2804 of the Streets and Highw, but also any mortgagee or beneficiary under any such existing mortgage or deed of required by Section 2804.2 of the Streets and Highways Code of the State of Californk PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City COI on the 16th day of January , 1990 by the following vote, to wit: AYES: Council Members Lewis, Kulchin, Pettine, Mamaux and NOES: None ABSENT: None ATTEST: ALETHA L.
