RESOLUTION NO. 90-47
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA FINDING THAT THE BANNERMAN
3 CUBIC YARD TOPDRESSER CAN ONLY BE OBTAINED FROM ONE SOURCE; ACCEPTING BID AND AUTHORIZING THE
EXECUTION OF A PURCHASE ORDER FOR SAME.

6 WHEREAS, the City of Carlsbad desires to purchasc
7 topdresser; and
WHEREAS, bids were solicited of potential vendors; and
WHEREAS, West Point Industries, Inc. submitted the (
responsive bid and is the sole distributor in Southern Calif01
for the Bannerman 3 cubic yard topdresser.

WHEREAS, the normal bidding procedure can be dispensed 6
pursuant to Carlsbad Municipal Code Section 3.28.090 (3) becz
staff surveyed vendors in the Southern California area and fc
only one vendor capable of providing the specified item
further advertised the availability of said item with only
vendor responding; and
I8 ll WHEREAS, there are sufficient funds in Account No. 001-€
19 I I 840-4121-3900 for this topdresser.

NOW, THEREFORE, BE IT RESOLVED by the City Council of
City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the bid of West Point Industries, Inc., as the E
source available is hereby accepted and the Purchasing Officer
hereby authorized to execute a Purchase Order for the purchasc
the topdresser.
