RESOLUTION NO. 90-71
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A REIMBURSEMENT AGREEMENT WITH THE CITY OF LOS ANGELES, BOARD OF HARBOR COMMISSIONERS, AND APPROVING A CONSULTANT AGREEMENT WITH MOFFATT AND NICHOL, ENGINEERS, INCORPORATED,
REGARDING THE BATIQUITOS LAGOON ENHANCEmNT
PROJECT
WHEREAS, the City of Los Angeles, acting by and th
its Board of Harbor Commissioners (Board) and the City of Car
(City) have previously executed agreement regarding a pro
project identified as the Batiquitos Lagoon Enhancement Pr
(Project) as potential mitigation for Los Angeles Harbor fills
WHEREAS, Board and City are parties to an agre
("MOA") involving various Federal and State regulatory and res
agencies establishing procedures and responsibilities for
design, construction, and maintenance of the project; and
WHEREAS, the MOA requires Carlsbad to administel
design and construction of said project in addition tc
permitting activities, acquisition of rights-of-way, and
project entitlements; and
WHEREAS, Board desires to fund costs associated
supplemental environmental and engineering studies, final de
and related consultant services for the continuation of
pro j ect ; and
WHEREAS, the City Council of the City of Carl
California, hereby finds it necessary, desirable, and in the F
interest to proceed with the agreement with the Board to affec
continuing activities of the project.

NOW, THEREFORE, BE IT RESOLVED as follows:
1. That the above recitations are true and corrt
2. That an agreement with the City of Los Anc
Board of Harbor Commissioners for supplemental environment;
engineering studies, final design, and related consultant sex
for the Batiquitos Lagoon Enhancement Project is hereby apy
and the Mayor and City Clerk are authorized and directed to e>
said agreement. Following the Mayor's and City Clerk's sigr
of said agreement, copies of this resolution and all accompe
agreements and exhibits are to forwarded to the Municipal Prc
Department and the Port of Los Angeles, attention: Lisa Sales
South Palos Verdes Street, P. 0. Box 151, San Pedro, Califo
90733-0151.
3. That an agreement with Moffatt and Nichol Engin
Incorporated, for supplemental engineering studies and final d
of the Batiquitos Lagoon Enhancement Project is hereby approve
the Mayor and City Clerk are authorized and directed to ex
said agreement. Following the execution of this agreement,
City Clerk is authorized and directed to forward copies of
agreement in accordance with the distribution identified in N
2 above.
4. That the value of the reimbursement agree
totaling $2,091,280 is hereby appropriated to the City proje

account with reimbursement funding available to accomplisl
objectives and work related to these agreements.
PASSED, APPROVED AND ADOPTED at a regular meeting c
Carlsbad City Council held on the 20th day of March
by the following vote, to wit:
