RESOLUTION NO. 90-124
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
AMENDMENT NO. 1 TO THE CONSULTANT CONTRACT
FOR THE BATIQUITOS LAGOON ENHANCEMENT
PROJECT
WHEREAS, the City Council of the City of Carlsb;
previously adopted Resolution No. 90-71 approving an agreemen
the Port of Los Angeles, Board of Harbor Commissioners
reimbursement funding for the Batiquitos Lagoon Enhanl
Project ; and
WHEREAS, said resolution also included the award
consultant contract to Moffatt and Nichol Engineers, Incorpo:
to perform said work: and
WHEREAS, the State of California, Department of Fi;
Game, has indicated it will open the mouth of Batiquitos Lag1
the near future to enable the lagoon to partially drain tl
uncovering nesting and foraging areas currently under water
WHEREAS, the consultants, Port staff, and City
unanimously agree that the upcoming lagoon opening providc
unique opportunity to study the lagoon hydraulics as well i
tidal inlet performance and abundant cobble during the open:
the lagoon: and
WHEREAS, a scope of work and fee schedule have
agreed to by the parties encompassing the work and cost to
the tidal inlet during this event: and
WHEREAS, the attached scope of work is not incluc
the master consultant agreement and is therefore identifi
extra work requiring Amendment No. 1.

NOW, THEREFORE, BE IT RESOLVED as follows:
1. That the above recitations are true and correct.
2. That Amendment No. 1 to the consultant contract fc
